<br /> <br />6 <br /> <br /> Identify any public water purveyor that may supply water for a proposed development project1 <br /> Request a WSA from the identified water purveyor <br /> <br />The purpose of the WSA is to demonstrate the sufficiency of the purveyor’s water supplies to satisfy the water <br />demands of the proposed development project, while still meeting the water purveyor’s existing and planned <br />future uses. Water Code sections 10910 through 10915 delineate the specific information that must be included <br />in the WSA. <br /> <br />The Proposed Project meets the project definitions included in Water Code §10910(a) and 10912(a)(3) because <br />it includes a proposed commercial office building employing more than 1,000 persons or having more than <br />250,000 square feet of floor space. <br /> <br />SB 221 amended State law (California Government Code section 66473.7) to require that approval by a city or <br />county of certain residential subdivisions2 requires an affirmative written verification of sufficient water supply. <br />SB 221 was intended as a fail-safe mechanism to ensure that collaboration on finding the needed water supplies <br />to serve a new large residential subdivision occurs before construction begins. Demonstration of compliance <br />with SB 221 typically coincides with approval of the tentative map for a new development project. <br /> <br />SB 221 is not applicable to the Project because it does not meet the definition of a Subdivision and is also exempt 3 <br />because it is “infill” development of an urbanized area that has been previously developed. <br /> <br />1.2 Purpose of Water Supply Assessment <br />As noted above, the WSA shall be included in the environmental document prepared for the project. In the case <br />of the 901 El Camino Real Project, it will be included in the Consistency Checklist prepared for the project. <br /> <br />At the stage of project approval/disapproval, pursuant to Water Code 10911(c), the City “shall determine based <br />on the entire record, whether projected water supplies will be sufficient to satisfy the demands of the project, <br />in addition to existing and planned future uses.” If the City determines at that point that water supplies will not <br />be sufficient, it must include that determination in its findings for the project. <br /> <br /> <br />1.3 Water Supply Assessment Preparation, Format and Organization <br />The format of this WSA follows Water Code sections 10910 through 10915 to clearly delineate consistency with <br />the specific requirements of SB 610.
