ATTY/RESO.0029/CC RESO APPROVING ARCHITECTUAL PERMIT, TENTATIVE PARCEL MAP (920 SHASTA) – EXHIBIT A <br />REV: 04-22-25 VR <br />Page 1 of 22 <br />EXHIBIT A – CONDITIONS OF APPROVAL <br /> <br />920 Shasta Street <br />AP2023-009 – Architectural Permit <br />TM2023-002 – Vesting Tentative Parel Map <br />The following Conditions of Approval [COA] and Standard Development Requirements [SDR] <br />apply to this project. The COAs are specific conditions applicable to the approved project (“the <br />Project”). The SDRs are items which are codified or adopted by resolution. The COAs and SDRs <br />are grouped by the responsible Department or category. <br />The applicant (“Applicant”) is responsible for complying with all conditions and standard <br />development requirements. The Applicant includes the applicant and any/all property <br />Applicants and/or successors in interest to the project property. <br />The Applicant shall comply with all applicable City, County, State, and Federal statutes, codes, <br />ordinances, resolutions, and regulations, including the following Conditions of Approval and <br />Standard Development Requirements: <br />Project Conformance <br />1. Related Agreements - The Project shall comply with and implement all terms of: (a) the <br />Affordable Housing Land Donation Agreement as approved by Resolution. (“Land Donation <br />Agreement”) and (b) the Partial Assignment and Assumption Agreement required by and <br />attached as Exhibit X to the 901 El Camino Real Development Agreement (“Development <br />Agreement”), which will partially assign certain affordable housing rights and <br />responsibilities of the 901 El Camino Real project to the Applicant (“Partial Assignment and <br />Assumption Agreement”). In the event of a conflict between the Land Donation Agreement <br />(including its exhibits), Partial Assignment and Assumption Agreement, and these <br />conditions of approval, the Land Donation Agreement shall control. [COA][PLANNING] <br />2. Substantial Conformity - The Applicant shall submit construction drawings that <br />substantially conform to the project plans prepared by David Baker Architects dated <br />February 21, 2025, the colors and material board in the project plans, and related <br />information submitted by the Applicant, on file with the Community Development <br />Department. The Applicant is hereby informed that Building permits must be obtained prior <br />to entitlement expiration. [COA][PLANNING] <br />3. Approval Letter & Conditions in Building Permit Plans – The Applicant shall print the Notice <br />of Final Decision, with the accompanying conditions of approval, and Mitigation, <br />Monitoring, and Reporting Program provided in the Consistency Checklist for this Project, <br />dated, April 1, 2025, and as listed in Attachment 1 of the Conditions of Approval, on the <br />first page of the building permit plans.
