ATTY/RESO.0031/CC RESO CEQA GUIDELINES (901 EL CAMINO REAL) <br />REV: 04-22-25 VR <br />Page 5 of 6 <br />a. The CEQA Consistency Checklist was prepared in accordance with all legal <br />requirements. <br /> <br />b. The City Council has reviewed and analyzed the CEQA Consistency <br />Checklist and other information in the entire Record and has considered the <br />information contained therein, including the written and oral comments received at <br />the public hearing on the Project, prior to acting upon or approving the Project. <br /> <br />c. Based on substantial evidence in the record, the proposed Project is <br />adequately analyzed and addressed in the previously certified DTPP EIR and <br />DTPP SEIR for the purposes of CEQA. The Statement of Overriding <br />Considerations and MMRPs associated with the certification of the DTPP EIR <br />and DTPP SEIR address the environmental effects of the Project. Accordingly, <br />with the approval of this Project, all applicable mitigation measures and the <br />Statement of Overriding Considerations are hereby reconfirmed and <br />readopted. <br /> <br />d. As indicated in the CEQA Consistency Checklist, 1) the DTPP applies form <br />based code which regulates land development to achieve specific urban form and <br />it does not restrict development density through dwellings units per acre or floor <br />area ratio; 2) the Project is consistent with the DTPP design regulations because <br />the proposed building fits within the allowable development envelope; and, 3) the <br />DTPP Plan-Wide Amendments program SEIR analyzed the increase in maximum <br />development cap resulting in part from redevelopment of 901 El Camino Real; and <br /> <br />e. As set forth in CEQA Guidelines Section 15183, Subdivisions (a), (b), and <br />(d), for the reasons stated in the Record, the proposed Project is consistent with <br />the General Plan and Downtown Precise Plan which provides the necessary <br />development standards to accommodate the proposed development density. <br />Further, as discussed in the CEQA Consistency Checklist, there are no <br />environmental effects which are peculiar to the Project or its site, nor are there any <br />new significant effects that were not already identified and analyzed in the certified <br />DTPP EIR and DTPP SEIR, nor are there any potentially significant off-site impacts <br />or cumulative impacts that were not already identified and analyzed in the certified <br />DTPP EIR and DTPP SEIR, nor is there substantial new information which was <br />not known at the time of the certification of the DTPP EIR and DTPP SEIR that <br />identifies any significant effects which will have a more severe adverse impact than <br />discussed in the certified DTPP EIR and DTPP SEIR. The feasible mitigation <br />measures specified in the DTPP EIR and DTPP SEIR have been included in the <br />Project’s Conditions of Approval. <br /> <br />f. As set forth in CEQA Guidelines Sections 15168, 15162, and 15163, the <br />proposed Project will not result in any new or more significant environmental <br />effects or require new mitigation measures beyond those identified in the DTPP <br />EIR and DTPP SEIR MMRPs. No new environmental document is required. As a <br />result, pursuant to Public Resources Code Section 21083.3 and CEQA Guidelines
