Caltrans - If a portion of the proposed work is within the State of California right-of-way <br />(Woodside Road, El Camino Real), the Applicant shall contact the California Department of <br />Transportation (Caltrans) at (510) 286-4417 to obtain all necessary Encroachment Permits. <br />[SDR][ENGINEERING] <br />114. Department of Fish and Wildlife, Army Corp of Engineers, Water Quality District – The <br />Applicant shall obtain all approval and necessary permits for any modifications to regulated <br />waters including but not limited to the proposed creek relocation prior to issuance of <br />grading or building permits. [COA] [ENGINEERING] <br />115. San Francisco Public Utility Commission (SFPUC) – The Applicant shall submit an <br />Underground Service Alert request to SFPUC prior to commencing construction. If the <br />proposed Project involves digging or excavation around or near the SFPUC’s pipeline, <br />further review will be required. Prior to issuance of grading or building permits, please <br />submit verification to the Community Development Department that all SFPUC <br />requirements have been met. Modifications - Permit modifications that include changing the use, altering any structure, <br />or modifying improvements shall be reviewed by the final review authority of the originally <br />approved permit, unless the Community Development Director determines that the change <br />is minor, and requires approval by the Zoning Administrator. [COA][PLANNING] <br />117. Failure to Comply with Conditions of Approval. If the Applicant constructs buildings or <br />makes improvements in accordance with these approvals, but fails to comply with any of <br />the Conditions of Approval or limitations set forth in these Conditions of Approval and does <br />not cure any such failure within a reasonable time after notice from the City, then such <br />failure shall be cause for non-issuance of a certificate of occupancy, revocation or <br />modification of these approvals, or any other remedies available to the City. <br />[COA][PLANNING] <br />118. Indemnification – Per Redwood City Code Section 1.54, the Applicant shall indemnify, <br />defend, and hold harmless the City, its officers, employees and agents, from any and all <br />claims and lawsuits from third party(s) involving or related to the City’s consideration <br />and/or approval of the Project. In doing so, Applicant shall defend (with counsel approved <br />by City), indemnify, and hold harmless the City, its agents, officers, and employees from <br />and against any claim, action, or proceeding (including without limitation any appeal or <br />petition for review thereof) against the City or its agents, officers or employees related to <br />an approval of the Project, including without limitation any related application, permit, <br />certification, condition, environmental determination, other approval, compliance or <br />failure to comply with applicable laws and regulations, and/or processing methods <br />(“Challenge”). City may (but is not obligated to) defend such Challenge as City, in its sole
