REV: 09-12-24 LF <br />(b) Providing that Contractor’s insurance will apply separately to each insured <br />against whom claim is made or suit is brought, except with respect to the limits of <br />the insurer’s liability (cross liability endorsement); <br />(c) Naming the City of Redwood City, its Council, officers, boards, <br />commissions, employees, and agents, as additional insureds; and <br />(d) Providing that Contractor’s insurance coverage will be primary insurance <br />with respect to City, its Council, officers, boards, commissions, employees, and <br />agents, and any insurance or self-insurance maintained by City for itself, its <br />Council, officers, boards, commissions, employees, or agents shall be in excess <br />of Contractor’s insurance and not contributory with it. <br />16. NON-DISCRIMINATION AND EQUAL OPPORTUNITY. Contractor warrants and <br />agrees it will not discriminate against any persons seeking services or employment under <br />this Agreement because of their age (40 and above), physical or mental disability, marital <br />status, race, color, national origin or ancestry, veteran status, religion, sex, pregnancy, <br />childbirth or related medical conditions, gender (including gender identity and gender <br />expression or perception), sexual orientation, medical condition, use of family medical <br />leave, or genetic testing, in the provision of services or extension of employment <br />opportunities under the Agreement. Contractor further warrants and agrees that it will <br />comply with all relevant local, state and Federal non-discrimination ordinances, statutes, <br />regulations, and executive orders pertaining to non-discrimination and equal opportunity, <br />including but not limited to, Title VI of the Civil Rights Act of 1964 as amended, Title VIII <br />of the Civil Rights Act of 1968 as amended, Section 104(b) and Section 109 of Title 1 of <br />the Housing and Community Development Act of 1974 as amended, Section 504 of the <br />Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age <br />Discrimination Act of 1975, Executive Order 11063 as amended by Executive Order <br />12259, and Executive Order 11246 as amended by Executive Orders 11375, <br />11478,12086, 12106, 13087, 13152, and 13672, 24 CFR Section 570.607, as revised by <br />Executive Order 13279. Contractor will include a statement that it is an equal opportunity <br />employer in all solicitations or advertisements for subcontractors or employees. <br />17. NONDISCRIMINATION IN THE PROVISION OF SERVICES <br />(a) Contractor hereby agrees that it will comply with the provisions of the <br />American with Disabilities Act (ADA) providing equal access and reasonable <br />accommodations in employment programs and services to persons who are <br />disabled and, if applicable, with Section 504 of the Rehabilitation Act of 1973. <br />(b) Contractor hereby agrees that in the provision of services and Program <br />activities, it will comply with all applicable local, state and federal laws and <br />regulations prohibiting discrimination and harassment. <br />18. INTEREST OF PUBLIC OFFICIALS.
