ii. Maintenance, Custodial Services, and Toilet Facilities <br />1. For indoor facilities: <br />a. The Owner shall ensure that indoor toilet facilities <br />are available for use by the User. <br />b. The Owner shall be responsible for maintaining <br />those indoor toilets. <br />c. The Owner shall be responsible for trash collection <br />and removal. <br />2. For public facilities: <br />a. The Owner shall open the facilities for public use <br />during non -school hours and until dusk unless <br />otherwise scheduled for third party use as described <br />in Section 3 of the main agreement. <br />b. The following conditions apply to the Parks Section <br />and Clubhouse Section of as listed in Section II. <br />i. Maintenance <br />For those areas marked on the above map as Parks, Pool and <br />Clubhouse, City shall have sole responsibility for maintenance and <br />utilities and shall provide sufficient personnel to operate and <br />maintain such facilities, notwithstanding the fact that District will <br />continue to have exclusive use of the area marked Parks during <br />school hours and for school activities. With respect to the <br />Clubhouse, City may delegate these responsibilities to a tenant, <br />provided however, City shall remain responsible to ensure that the <br />tenant properly maintains said property. Maintenance shall be at a <br />level comparable to other City parks. <br />ii. Pool Maintenance <br />The City shall maintain and operate the swimming pool at its sole <br />expense, it being understood by both parties that the District is no <br />longer using the swimming pool in its school programs. Should the <br />District decide to use the swimming pool for school purposes in the <br />future, the parties shall amend this Agreement to provide for <br />equitable sharing of the cost of pool maintenance. <br />iii. Custodial Services <br />Because use of the recreational facilities provided for herein has <br />resulted in the past, and may result in the future, in debris being <br />REV: 10-04-24 VR <br />ATTY/AGR.2024/Amend.
