The issues raised in any such action or proceeding may be limited to <br />those raised in such an objection unless a court finds the issue could not have been raised <br />in such an objection by those exercising reasonable diligence; and <br /> <br />WHEREAS, in addition to submitting objections, Proposition 218 permits <br />ratepayers and property owners to submit written protests to the proposed water rates up <br />until the close of the public hearing on the proposed rates or charges. While both <br />ratepayers and property owners may submit protests, only one protest per parcel shall be <br />counted; and <br /> <br />WHEREAS, after the close of the public hearing, the City Clerk shall tabulate all <br />written protests, report on the number of protests received, and determine whether a <br />majority protest exists, and if a majority protest does not exist, the City Council may adopt <br />the proposed water rates; and <br /> <br />WHEREAS, the City desires to initiate proceedings under Proposition 218 and, in <br />compliance with Government Code section 53759.1, to consider the adoption of the water <br />rates. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br /> <br />1. That the above recitals are correct and are material to this Resolution and <br />are incorporated into this Resolution as findings of the City Council. <br /> <br />2. That this Resolution has been reviewed with respect to applicability of the <br />California Environmental Quality Act (“CEQA”) and the CEQA Guidelines. This Resolution <br />is not a project pursuant to Public Resources Code section 21065 or CEQA Guidelines <br />section 15378(b)(4) because there is no possibility that it may cause either a direct <br />change in the environment or a reasonably foreseeable indirect physical impact in the <br />environment. <br /> <br />3. That the City shall initiate the process for the City Council to consider the <br />proposed water rates in compliance with Proposition 218 and Government Code section <br />53759.1. <br /> <br />4. That the City shall send a Proposition 218 Public Hearing Notice in <br />substantially the form as depicted in the attached Exhibit A of this Resolution and <br />incorporated by this reference, no later than Monday, August 11, 2025. <br /> <br />5. That all objections to the proposed water rates must satisfy the <br />requirements set forth in the Proposition 218 notice and to be timely must be received by <br />the City by 4:00 p.m. on Thursday, September 25, 2025. <br />
