It would <br />also disrupt the current Compost Broker Program outreach, education, assistance, and services to farmers <br />and ranchers who have already agreed to participate in the program with RCD. There is no guarantee that <br />farmers and ranchers would participate in a program with another consultant, since they would still have <br />agreements in place with the County and other jurisdictions of San Mateo. Additionally, there is no <br />guarantee that a new consultant would be able to make connections with current participants or new <br />farmers and ranchers, implement the program, and be able to meet the SB 1383 procurement targets in <br />the time remaining to expend the CalRecycle grant funds. For these reasons, RCD is the only reasonable <br />consultant that will be able to provide program compatibility and continuity for the City. Therefore, this <br />Amendment meets the criteria for the sole source exemption under the City’s Purchasing Ordinance and <br />is necessary to continue the Compost Broker Program through the CalRecycle grant cycle efficiently and <br />cost effectively. <br />FISCAL IMPACT <br />The City was awarded a grant from CalRecycle which provides the full funding for the Compost Broker <br />Program through the proposed Amendment to the Agreement with RCD. This is included in the FY 2025- <br />26 budget, and no new allocations will be needed. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to approve the Amendment which would result in the City having to <br />develop an alternative strategy for procuring and utilizing the compost tonnage required under SB 1383 <br />to expend the remaining grant funds or returning the unused funds to CalRecycle. <br />7.Q. - Page 3 of 28 <br />395
