Under the Compost Broker Program, RCD has been offering reduced-cost compost to San Mateo County farmers and ranchers, conducting outreach to farmers and ranchers, providing technical assistance for compost application, identifying and coordinating projects, and assisting them with accessing other funding programs for compost procurement. The County has assisted jurisdictions, including Redwood City, with applying for CalRecycle SB 1383 Local Assistance grants to procure compost and to continue participating in the Compost Broker Program. On February 27, 2024, Redwood City was awarded $219,107 for the two-year grant program cycle, $75,094.01 of which was designated in the grant application for the Compost Broker Program. ANALYSIS On April 3, 2025, the County informed participating jurisdictions that the Compost Broker Program met 44 percent of the 2024 SB 1383 procurement targets, surpassing the total goal for both 2024 and 2025 set in the CalRecycle SB 1383 Local Assistance Grant application. Along with this success, the County estimated another 4,000 tons of compost will be procured in 2025 with the funds already allocated through the grant. The County notified participating jurisdictions, including the City, that RCD has additional capacity to increase compost procurement in Fall of 2025 and meet the total 2025 SB 1383 procurement targets. Participating jurisdictions can amend their agreements with RCD and use any surplus grant funds to take advantage of this opportunity. Staff recommend amending the City’s agreement with RCD to expend the surplus grant funds to potentially meet the 2025 procurement target. The Amendment would increase the not-to-exceed amount of the Agreement by $124,905.99 and amend the scope of services, for a total not-to-exceed agreement amount of $200,000 through May 1, 2026. Pursuant to the City’s Purchasing Ordinance, staff recommend the use of the City’s sole source exemption for the Compost Broker Program Agreement. Specifically, this Agreement qualifies for the exemption because of the Compost Broker Program’s “uniqueness, compatibility with existing City programs, equipment or systems,” as described in the City’s Purchasing Ordinance. Per Section 2.67.4 (A) of Chapter 2, Article VII in the City’s Municipal Code, Sole Source: A purchase may be made, or contract awarded without a competitive bidding process when there is only one reasonable and practicable source for the required goods, materials, equipment, supplies or support service because of its uniqueness, quality, durability, availability, compatibility with existing City programs, equipment or systems or fitness for a particular use. Such a sole source purchase must be determined to meet these requirements and be recommended for approval by the City Manager and shall be approved only on the affirmative votes of at least five members of the City Council. The Compost Broker Program was specifically developed by the County, San Mateo jurisdictions, and RCD to help meet the SB 1383 compost procurement targets.
