REV: 07-03-25 VR <br />Payments shall be provided in the following way: <br />1. 20% upon execution of the contract <br />2. 40% upon the initial work on Phase 1 <br />3. 40% upon successful completion of the installed mural and upon satisfaction <br />by the City. <br />4. Time of Performance. <br />Artist shall coordinate commencement, installation, and completion of the Work <br />with the representative assigned as project coordinator from the Parks <br />Department. Design work shall commence upon receipt of deposit, with first draft <br />completed in one week, and an additional week allotted for any revisions if needed. <br />Phase 1 of the project will take approximately two weeks to complete, and Phase 2 <br />will require an additional two weeks. Artist will immediately notify the City of any <br />delay that occurs or is anticipated in the date of delivery installation or <br />completion. The completion date for the Work may be extended for a reasonable <br />amount of time as a result of circumstances and events beyond the control of <br />Artist or upon written agreement by the Parties. <br />5. Approvals. <br />The Artist shall provide designated representatives of the City the opportunity to <br />review inspect, and approve the Work’s progress at each of the designated <br />times and stages listed below: <br />A. Subtle design refinements and/or improvements to the work left to the <br />discretion of the Artist; and <br />B. Initial inspection of the Work and/or working drawings after design phase <br />to determine that the Work is in keeping with the Artist representations; <br />and <br />C. Periodic on-site inspections as Work progresses; and <br />D. Final inspection and acceptance after installation. <br />The reviews shall occur within two weeks of the Artist’s written notice to the City <br />of readiness for the review. <br />If the Work does not conform to the proposal as described in this Exhibit A or as <br />mutually agreed by the parties, notice of specific non-conformity and request for <br />the Artist to address the specific non-conformity shall be given to Artist in writing <br />within two weeks after the review period. Artist shall have thirty days to address <br />and correct any non-conformity. If, after resubmission, the Work still does not <br />conform, the City retains the right to immediately terminate the agreement and <br />remove the non-conforming work product. <br />6.Project Close-out. <br />Upon completion and installation of the Work, the Artist will furnish the City with <br />a full Release and Waiver of Lien, plus releases from any major supplier or <br />subcontractor involved with the Work.
