REV: 07-03-25 VR Payments shall be provided in the following way: 1. 20% upon execution of the contract 2. 40% upon the initial work on Phase 1 3. 40% upon successful completion of the installed mural and upon satisfaction by the City. 4. Time of Performance. Artist shall coordinate commencement, installation, and completion of the Work with the representative assigned as project coordinator from the Parks Department. Design work shall commence upon receipt of deposit, with first draft completed in one week, and an additional week allotted for any revisions if needed. Phase 1 of the project will take approximately two weeks to complete, and Phase 2 will require an additional two weeks. Artist will immediately notify the City of any delay that occurs or is anticipated in the date of delivery installation or completion. The completion date for the Work may be extended for a reasonable amount of time as a result of circumstances and events beyond the control of Artist or upon written agreement by the Parties. 5. Approvals. The Artist shall provide designated representatives of the City the opportunity to review inspect, and approve the Work’s progress at each of the designated times and stages listed below: A. Subtle design refinements and/or improvements to the work left to the discretion of the Artist; and B. Initial inspection of the Work and/or working drawings after design phase to determine that the Work is in keeping with the Artist representations; and C. Periodic on-site inspections as Work progresses; and D. Final inspection and acceptance after installation. The reviews shall occur within two weeks of the Artist’s written notice to the City of readiness for the review. If the Work does not conform to the proposal as described in this Exhibit A or as mutually agreed by the parties, notice of specific non-conformity and request for the Artist to address the specific non-conformity shall be given to Artist in writing within two weeks after the review period. Artist shall have thirty days to address and correct any non-conformity. If, after resubmission, the Work still does not conform, the City retains the right to immediately terminate the agreement and remove the non-conforming work product. 6.Project Close-out. Upon completion and installation of the Work, the Artist will furnish the City with a full Release and Waiver of Lien, plus releases from any major supplier or subcontractor involved with the Work.
