2 <br /> <br />WHEREAS, the County has developed a robust enforcement process under its <br />Hopeful Horizons Ordinance, including, without limitation, coordination with the County’s <br />Human Services Agency’s Center on Homelessness (“COH”), and its contracted outreach, <br />Coordinated Entry, and shelter providers on pre-enforcement engagement efforts and <br />shelter availability, preparation of the required warnings and citation, retention of <br />experienced enforcement staff, and working with both the San Mateo County District <br />Attorney’s Office and San Mateo County Superior Court on procedures for misdemeanor <br />violations and diversion options for violators; and <br />WHEREAS, it has been the County’s intent and desire for its Hopeful Horizons <br />Ordinance to serve as a model ordinance for cities in San Mateo County so that all residents <br />are provided access to safe, healthy, and dignified shelter consistent with maintaining <br />Functional Zero homelessness, where every unsheltered person San Mateo County who <br />chooses assistance will be provided interim or permanent housing; and <br />WHEREAS, homeless encampments are often plagued by fire risks, unsanitary <br />conditions, public safety hazards, and environmental degradation; are unsafe and unhealthy <br />for individuals living in them; and make surrounding communities less safe and less <br />healthy; and <br />WHEREAS, the negative impacts associated with homeless encampments are felt <br />across jurisdictional boundaries throughout San Mateo County and there is a shared benefit <br />among jurisdictions to coordinated enforcement actions and coordinated efforts to place <br />homeless individuals in safe, healthy, and dignified available shelter; and <br />WHEREAS, on September 8, 2025, the City adopted an ordinance entitled <br />“Hopeful Horizons: Empowering Lives Initiative” adding Chapter 49 to its Municipal <br />Code (“City’s Hopeful Horizons Ordinance”), which is modeled on the County’s Hopeful <br />Horizons Ordinance; and <br />WHEREAS, the City desires to utilize the County’s developed expertise and <br />resources to enforce the City’s Hopeful Horizons Ordinance and, for the reasons set forth <br />in the above findings, doing so will serve a public purpose for both Parties. <br />NOW THEREFORE, the Parties wish to reflect their intent and their respective <br />responsibilities and obligations with regard to enforcement of the City’s Hopeful Horizons <br />Ordinance, and such other matters as specified herein. <br /> Terms <br />A. Purpose.
