3 <br /> <br />B. Term. This MOU is effective upon the Effective Date and shall remain in <br />effect until June 30, 2027, unless modified by written amendment executed by the Parties. <br />This MOU may be terminated by either Party following a good faith attempt by the Parties <br />to meet and confer as described in Section 12, below, upon 10 days written Notice. <br /> <br />C. Responsibilities of the Parties. <br /> <br />1. The City will be responsible for the following enforcement-related actions <br />under the City’s Hopeful Horizons Ordinance: <br /> <br />i. The City shall perform all pre-enforcement activities, including, <br />without limitation: identification of homeless encampments within <br />the City in need of removal/clean-up; coordination with the <br />County’s contracted Homeless Outreach Team (“HOT”) provider <br />regarding pre-enforcement outreach to individuals residing in <br />encampments scheduled for clearance; coordination with HSA’s <br />Center on Homelessness to identify whether a shelter bed is <br />available for those at the identified encampments; coordination with <br />County’s Executive Office to enlist their contracted code <br />enforcement staff; and confirmation that the City Police and City <br />Public Works Departments are available to assist with anticipated <br />removal/clean-up; and <br />ii. The City shall provide the County with a minimum of 14 days’ <br />notice prior to any clearance, except where exigent circumstances <br />exist or if the encampment is located in an eligible Sensitive Area as <br />defined by Section 49.1(e) of the City’s Hopeful Horizons <br />Ordinance; and <br />iii. City shall provide one point of contact to complete and request the <br />Protect Personal Information form to COH, attached as Exhibit A <br />(this point of contact will be required to sign the County’s AB210 <br />Agreement, attached as Exhibit B); and <br />iv. The City shall post any/all encampment removal/clean-up notices, <br />perform (or arrange to perform) any/all encampment removal/clean- <br />up activities, and store of any/all personal property collected from <br />encampments, all in compliance with Section 49.6 of the City’s <br />Hopeful Horizons Ordinance. <br /> <br />2. The County will be responsible for issuance of warnings and citations in <br />compliance with Section 49.5(a) of the City’s Hopeful Horizons <br />Ordinance. The City, as needed, may also issue warnings and citations in <br />compliance with Section 49.5(a) of the City’s Hopeful Horizons <br />Ordinance.
