its own cost and expense and upon request so to do by City, <br />remove the said gates and fences placed upon the subject property. <br />7. Release. Permittee shall be responsible and liable for <br />all damages to persons or property, including the injury or death <br />of persons, due directly or indirectly to Permittee's construction <br />and/or maintenance of the said gates and fences and the use <br />permitted hereunder, and shall promptly pay any just claim <br />therefor and shall hold the City of Redwood City, its Council, <br />officers, boards, commissions, councilmen, agents and employees <br />harmless from all suits, actions, damages, or claims to which <br />said City may be subjected by reason of said construction and/or <br />maintenance of said gates and fences or encroachment or use <br />thereof permitted hereunder. <br />8. Fee. Permittee shall pay to the City of Redwood City <br />the sum of Fifty Dollars ($50.00) upon execution and acceptance <br />hereof by Permittee for expenses incurred by the City of Redwood <br />City in the preparation of and processing of this permit. <br />9. Abandonment of Improvements. In the event that Permittee <br />abandons or fails to use the said gates or fences for a period <br />of one year, or shall fail or neglect or refuse to comply with <br />any of the conditions herein contained, or in the event that this <br />permission shall be revoked, than all rights of the Permittee <br />hereunder shall forthwith cease and determine. <br />10. Successors. The terms and conditions hereof shall be <br />binding upon the heirs, assigns, and successors in interest of <br />Permittee, and said terms and conditions shall run with, and be <br />and equitable servitude, upon the above described real property <br />of Permittee. <br />-3- <br />
