None of the conditions identified in State CEQA Guidelines Section 15162 requiring further subsequent environmental review have occurred because: 1) The Modified Project does not constitute a substantial change to the Project that would require major revisions to the 2019 EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of the previously identified significant effects; and 2) There have been no substantial changes with respect to the circumstances under which the Modified Project will be constructed that would require major revisions to the 2019 EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of the previously identified significant effects; and 3) There has been no new information of substantial importance that was not known and could not have been known with the exercise of reasonable diligence at the time the 2019 EIR was certified that has come to light, and that shows any of the following: (i) that Modified Project would have one or more significant effects not discussed in the 2019 EIR; (ii) that significant effects previously examined would be substantially more severe than shown in the 2019 EIR; (iii) that mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects, but the City Council declined to adopt such measures; or (iv) that mitigation measures or alternatives considerably different from those analyzed previously would substantially reduce one or more significant effects on the environment, but which the City Council declined to adopt. b. Based on substantial evidence in the record, the Modified Project is adequately analyzed and addressed in the previously certified 2019 EIR for the purposes of CEQA. The Statement of Overriding Considerations and MMRP associated with the certification of the 2019 EIR addresses the environmental effects of the Project. Accordingly, with the approval of the Modified Project and adoption of this Addendum #2, all applicable findings, mitigation measures, and the Statement of Overriding Considerations are hereby reconfirmed, readopted, and incorporated herein by reference. c. The City Council hereby considers and approved Addendum #2, attached hereto as Exhibit A.
