ATTY/RESO.0109/CC RESO WATER RATES <br />REV: 11-05-25 MI <br />Page 2 of 5 <br />•The date, time, and place of a public hearing to consider the rate <br />modifications; and <br />WHEREAS, on July 21, 2025, the City Council adopted Resolution No. 16339 to <br />initiate proceedings under Proposition 218 by scheduling a Public Hearing to consider <br />adopting proposed water rates, authorizing the mailing of the notice (“Proposition 218 <br />Notice”), and establishing procedures for considering objections to the proposed water <br />rates; and <br />WHEREAS, the Proposition 218 Notices were mailed on August 7, 2025, to <br />owners of record for all parcels receiving water services from the City; and <br />WHEREAS, pursuant to AB 2257, which became effective January 1, 2025, if the <br />City complies with the requirements in Government Code section 53759.1, then <br />ratepayers must bring an objection regarding the proposed water service rates to the City <br />Council's attention prior to the deadline established by the Council as part of the <br />ratemaking process and any judicial action or proceeding to review, invalidate, challenge, <br />set aside, rescind, void, or annul the water service rates shall be subject to the <br />requirements set forth in Government Code section 53759.2; and <br />WHEREAS, the City's Proposition 218 Notice complied with Government Code <br />sections 53755, 53756, 53759, and 53759.1, including the following requirements: <br />1.The City established a deadline of 4:00pm on September 25, 2025, to submit <br />a written objection to the proposed water service rates, which is at least 45 <br />days after the Proposition 218 Notice was mailed on August 7, 2025; and <br />2.The City made its proposed water service rates available to the public on <br />August 7, 2025, which is at least 45 days before the September 25, 2025 <br />deadline to submit a written objection. Further, the City made the Water Rate <br />Study available to the public, by posting the Study on its website and filing the <br />Study with the City Clerk's office at least 45 days before the September 25, <br />2025 deadline to submit a written objection; and <br />3.The City posted both the Water Rate Study and the Proposition 218 Notice on <br />its website, and it included in the Proposition 218 Notice a link to the Water <br />Rate Study; and <br />4.The City included in its Proposition 218 Notice the option for a property owner <br />to request that the City mail the Water Rate Study; and <br />5.The City included, in its Proposition 218 Notice, a prominently displayed <br />statement, which included the deadline for submission of a written objection to <br />the City Clerk (4:00pm on September 25, 2025), and notified the ratepayer that <br />the failure to timely object bars any right to challenge the water service rates <br />through a legal proceeding and that such action may be limited to issues <br />identified in the challenger's objection. Further, the Proposition 218 Notice <br />included a prominently displayed statement that lists the substantive and <br />procedural requirements for filing a written objection to the proposed water <br />service rates; and
