The Proposition 218 Notice included a statement that variations in San <br />Francisco Public Utility Commission (“SFPUC”) rates for wholesale water may <br />be passed through to water ratepayers, by adjusting water rates accordingly; <br />and <br />7. The Proposition 218 Notice included a statement that there is a 120-day statute <br />of limitations for challenging the water rates should the proposed water rates <br />be adopted. <br /> <br />WHEREAS, the City Council conducted a public hearing on this matter on <br />November 10, 2025, not less than forty-five days after the notices were mailed; and <br /> <br />WHEREAS, the agenda materials for the water service rate update included all <br />written objections received by the September 25, 2025 deadline and the City's written <br />responses to those objections; and <br /> <br />WHEREAS, at the public hearing, the City Council considered all timely written <br />objections and the written responses to those objections. The City's responses explained <br />the substantive basis for retaining the proposed water service rates, at the amounts <br />recommended in the Water Rate Study, including the reasons the City rejected any <br />requested amendments; and <br /> <br />WHEREAS, the City Clerk tabulated the written protests received prior to the public <br />hearing, along with those received on the day of the hearing; and <br /> <br />WHEREAS, the City Council evaluated the proposed rates, heard all oral <br />testimony, considered all written materials and written protests and objections concerning <br />the adoption and imposition of the proposed increases to rates for water service charges; <br />and <br /> <br />WHEREAS, at the close of the public hearing, the tabulation results concluded that <br />the City did not receive a majority protest against the establishment and imposition of the <br />proposed increases for water service rates from a majority of the affected parcels directly <br />liable for the payment of water service charges. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY, AS FOLLOWS: <br /> <br />1. The matters set forth above are true and correct statements and are legislative <br />findings and determinations by the City Council and by this reference made an <br />operative part of this Resolution. <br /> <br />2. In accordance with the California Environmental Quality Act (CEQA) and the <br />CEQA Guidelines, the City Council has determined that the increases in the <br />water service rates are exempt from CEQA pursuant to CEQA Section <br />21080(b)(8) and CEQA Guidelines Sections 15273 and 15378(b)(4) because: <br />(i) the increased charges are for the purpose of meeting operational and
