While the appeal is pending, the <br />time period for offering the tenant the right to re-rent <br />the rental unit in Section 42.5(B)(2)(d)(iv)(I) shall be <br />tolled. The landlord shall notify the tenant of offer <br />to re-rent the rental unit at the rent determined by <br />the appeal decision no later than ten (10) calendar <br />days following the date of notice of the appeal <br />decision. The City shall collect the administrative <br />fee from the landlord to process the appeal in an <br />amount to be set by resolution of the City Council. <br /> <br />e. The landlord, after having obtained all permits, intends to <br />demolish the rental units on the property. <br /> <br />i. A written notice terminating a tenancy for a just cause <br />pursuant to this subsection (e) shall include all of the <br />following information: <br /> <br />I. A statement informing the tenant of the landlord’s <br />intent to demolish the rental unit; and <br /> <br />II. The following statement: “If the demolition of your <br />rental unit or the property as described in this notice <br />of termination is not commenced or completed, the <br />landlord must offer you the opportunity to re-rent <br />your rental unit with a lease containing the same <br />terms as your most recent lease with the landlord at <br />the rental rate that was in effect at the time you <br />vacated. You must notify the landlord within thirty <br />(30) days of receipt of the offer to re-rent of your <br />acceptance or rejection of the offer, and, if <br />accepted, you must reoccupy the rental unit within <br />thirty (30) days of notifying the landlord of your <br />acceptance of the offer.” <br /> <br />ii. Tenants whose tenancy is terminated pursuant to this <br />subsection (e) shall be entitled to relocation assistance as <br />provided in this Chapter unless the demolition is in <br />connection with an application to develop the property for <br />another use and the tenant is entitled to relocation <br />assistance pursuant to Government Code Sections <br />66300.5 et seq. <br />
