Housing that has been issued a certificate of occupancy within the <br />previous 15 years, unless the housing is a mobilehome. <br /> <br />8. Rental unit, including a mobilehome, that is alienable separate from <br />the title to any other dwelling unit, provided that the following applies: <br /> <br />a. The owner is not any of the following: <br /> <br />1. A real estate investment trust, as defined in the Internal <br />Revenue Code Section 856. <br /> <br />2. A corporation. <br /> <br />3. A limited liability company in which at least one <br />member is a corporation. <br /> <br />4. Management of a mobilehome park, as defined in Civil <br />Code Section 798.2. <br /> <br />9. Housing restricted by deed, regulatory restriction contained in an <br />agreement with a government agency, or other recorded document as <br />affordable housing for persons and families of very low, low, or moderate <br />income, as defined in Health and Safety Code Section 50093, or subject to <br />an agreement that provides housing subsidies for affordable housing for <br />persons and families of very low, low, or moderate income, as defined in <br />Health and Safety Code Section 50093 or comparable federal statutes. <br /> <br />I. “Residential household.” Any person or group of persons entitled to occupy <br />a rental unit under a lease with the landlord. <br /> <br />J. “Special-circumstances household.” An eligible residential household (as <br />defined in Section 42.3(B)) that has any of the following characteristics: <br /> <br />1. At least one (1) member is sixty-two (62) years of age or older. <br /> <br />2. At least one (1) member qualifies as disabled as defined by Title 42, <br />United States Code, Section 423 or Government Code Section 12955.3. <br /> <br />3. A household with one (1) or more minor children (under eighteen (18) <br />years of age) who are legally dependent (as determined for federal income <br />tax purposes). <br /> <br />4. A household that has occupied their rental unit as their primary <br />residence for five (5) or more consecutive years. <br />
