ATTY/ORD.0011/CC ORD TENANT PROTECTION ORDINANCE <br />REV: 10-07-25 LF <br />Page 7 of 23 <br />K. “Tenancy.” The lawful occupation of a rental unit, including, but not limited <br />to, a lease. <br /> <br />L. “Tenant.” A tenant, subtenant, lessee, sublessee, or any other person <br />entitled to the use or occupancy of a rental unit, to the exclusion of others, under <br />a lease with the landlord. <br /> <br />42.4 Requirement to Offer Minimum Lease Terms <br /> <br />A. One-Year Lease Term Upon Initial Lease. If a prospective tenant wishes to <br />rent a rental unit from a landlord and the landlord wishes to rent the rental unit to <br />the prospective tenant, the landlord must offer to the prospective tenant a written <br />lease which has a minimum term of one (1) year. Offers must be made in writing. <br />Signing of a lease which has a minimum term of one (1) year shall be considered <br />an offer in writing. If the prospective tenant rejects the offer for a written lease <br />which has a minimum term of one year, such rejection must be in writing (which <br />may include email or text message) and provided to landlord within fifteen (15) <br />days of receipt of the landlord’s offer. <br /> <br />B. Shorter Term. If a prospective tenant rejects the offer for written lease which <br />has a minimum term of one (1) year, the landlord and the prospective tenant may <br />enter into a written lease that provides for a term of less than one (1) year. <br /> <br />C. Rent. If the landlord and tenant enter into a written lease which has a <br />minimum term of one (1) year, such lease must set the rent for the rental unit at a <br />rate or rates certain and these rates shall not otherwise be modified during the <br />initial term of such lease. <br /> <br />D. Notice of Tenant’s Right to Minimum Lease Term. <br /> <br />1. Form. Landlords shall provide all prospective tenants with a notice <br />summarizing the rights afforded by this Section. The notification shall be <br />capitalized text in at least twelve (12) points in font size and shall state: <br /> <br />THE REDWOOD CITY CODE PROVIDES YOU WITH THE RIGHT <br />TO MINIMUM LEASE TERMS. LANDLORDS MUST OFFER <br />TENANTS THE OPTION TO ENTER INTO A ONE (1) YEAR <br />WRITTEN LEASE.
