Violation of California Constitution, Article XIII D, Section 6(b)(1): The proposed rates <br />exceed the proportional cost of service attributable to parcels. For example, under the <br />proposed adjustments, fixed service charges for larger meters appear <br />disproportionate relative to actual incremental cost-of-service data, as shown in the <br />Water Rate Study. <br />2. Violation of Article XIII D, Section 6(b)(3): Revenues generated from the rate <br />adjustments may exceed the funds required to provide water service, particularly with <br />the escalation of the capital reserve beyond demonstrated cost justification tied to <br />parcel-level service. <br />3. Insufficient Cost Justification: The transition to a uniform volumetric rate removes <br />tiered conservation pricing without sufficient justification that this method best reflects
