It is a compilation of City ordinances governing certain activities within the City. The Municipal <br />Code establishes the rules and regulations for situations and issues, including but not limited to land <br />development, building construction, fire prevention, and health and sanitation. <br />Periodically, the Municipal Code is updated to maintain consistency and compliance with state and federal <br />laws, regulations, and recommendations; for revised City program standards; and to clarify existing <br />Municipal Code language. <br />ANALYSIS <br />This ordinance proposes amendments to four Municipal Code chapters to clarify or amend existing City <br />regulations or processes related to public and private development. Staff consider these amendments to <br />be minor in scope and impact. Highlighted changes for the proposed changes are briefly explained below: <br />Chapter 18, Local Improvements and Planning <br />To clarify requirements related to below ground electrical, telephone, communications, and cable TV <br />lines. <br />Section 18.242 updates the language to clarify that any underground lines shall remain <br />underground. <br />Areas of the City contain both overhead and underground lines for electric, telephone, communications, <br />and cable TV distribution and services. Where any distribution or service line has been placed <br />underground, this code update clarifies that any replacement of these distribution lines or services also <br />must be placed underground. <br />Chapter 27A, Stormwater Management and Discharge Control Program <br />To identify requirements and prohibited actions for proposed development within watercourse setbacks. <br />Section 27A.11 <br />o Changes approval authority from “City’s Director” to City Engineer <br />o Adds and replaces language to clarify that the section applies to all “watercourses” as <br />defined within Section 27A.3. <br />Section 27A.12 <br />o Changes approval authority from “City’s Director” to City Engineer <br />o Adds and replaces language for consistency with “watercourses” as defined in Section <br />27A.3 <br />Section 27A.13 <br />o Adds and replaces language for consistency with “watercourses” as defined in Section <br />27A.3 <br />o Adds language to clarify property owner and City responsibilities concerning watercourse <br />maintenance <br />8.A. - Page 2 of 24 <br />141
