REFUSE BECOMES PROPERTY OF COLLECTOR: <br />Unless specifically stated in a written agreement between the refuse collector and the City Council, all refuse, once <br />collected, becomes the property of the refuse collector to dispose of as he sees fit; provided, that the manner of <br />disposal does not conflict with any provisions of this Chapter. <br />Sec. 14.28. HEALTH OFFICER TO SETTLE DISPUTES: <br />In all cases of disputes or complaints arising from or concerning the place where receptacles for refuse shall be <br />placed awaiting the removal of their contents, the quantities to be removed and the number of times of removal, <br />the Health Officer shall designate the place, the estimated quantity, and the times and manner of removal. <br />DIVISION 2. CHARGES <br />Sec. 14.29. PURPOSE; CITY MAY IMPOSE ADDITIONAL CHARGES: <br />A. A franchise fee may be established by resolution of the City Council and may be modified by the City Council <br />at any time during the term of any franchise. <br />B. The City Council is authorized to establish or modify any other fee related to the provision of solid waste <br />collection services by resolution. <br />Sec. 14.30. RESERVED: <br />Sec. 14.31. MAXIMUM RATES TO BE ESTABLISHED BY RESOLUTION: <br />The maximum rates for sanitary inspection and refuse collection services that may be charged by any Refuse <br />Collector shall be approved by resolution of the City Council, pursuant to the requirements set forth in the franchise <br />agreement. <br />Sec. 14.32. RESERVED: <br />Secs. 14.33—14.34. RESERVED: <br />DIVISION 3. TRANSPORTING <br />Sec. 14.35. TRUCKS—MANNER OF HAULING; CONSTRUCTION AND EQUIPMENT <br />REQUIREMENTS: <br />A. All garbage collected in the City shall be hauled in all-steel watertight bodied motor trucks, and taken to the <br />dump or incinerator in such a manner as not to be needlessly offensive and filthy in relation to any person, <br />place, building, premises or highway. The truck bodies shall be constructed of iron of sufficient strength as <br />to withstand a fire within, without endangering adjacent property. Each truck shall be equipped with a <br />tarpaulin or other suitable covering which shall be drawn over the load as completed to full depth. All refuse <br />in the truck shall be completely covered between points of collection and disposal. <br />B. This Division 3 shall not apply to persons who have successfully obtained a waiver and/or a self-haul permit <br />from the City pursuant to Section 14.2 and/or Section 14.22 of this Chapter. <br />Sec. 14.36. TRUCKS—WASHING, PAINTING AND NUMBERING: <br />The bodies of the garbage trucks shall be washed at least once a week and painted once each year and otherwise <br />appear as neat as possible under the circumstances. Each truck shall be numbered and the number thereof shall <br />appear on the side of the truck in numbers not smaller than six inches (6″) high.
