PWS has projects in the planning phase that will require MEP engineering and related services, <br />and the need for these services will be ongoing to support recurring operations. <br />Section 2.67.1(A) of the City’s Municipal Code authorizes using cooperative purchasing with other public <br />agencies to forego a competitive bidding process when contracts have already been awarded for the <br />desired goods or services. To do so, competitive purchasing procedures reasonably similar to those <br />required by the City, as determined by the City Manager, must have been employed to create such <br />contracts. <br />The County of Santa Clara (“County”) issued a Request for Statement of Qualifications (“RFSOQ”) for as- <br />needed MEP engineering services, which aligns with the services required by the City. Notification of the <br />RFSOQ was given to prospective bidders through a bid management portal utilized by the County. The <br />RFSOQ process allowed the County to consider qualifications in addition to pricing when evaluating <br />proposals. This process is similar, if not identical, to the process the City would perform if it were to issue <br />a solicitation for the same professional services. Following their review of proposals and selection process, <br />the County of Santa Clara awarded a five-year agreement to YEI Engineers, Inc. (“YEI”) in 2024. <br />ANALYSIS <br />Staff has verified that the County agreement with YEI is still active, and YEI has expressed a willingness to <br />honor the same pricing structure contained in the County’s contract. <br />The purchasing procedures employed in the creation of the County’s contract were as follows: <br />• Issuance of an RFSOQ <br />• Notice sent to prospective proposers <br />• Evaluation and selection by committee <br />• Execution of a service agreement <br />The procedures listed above are reasonably similar to those the City would utilize to procure the desired <br />services, thereby meeting the criteria of Section 2.67.1(A). Awarding an agreement to YEI will create <br />efficiencies for the City and allow staff to move forward with numerous projects that are expected to be <br />completed in the coming years. The City currently has multiple projects that YEI has designed to 100% <br />completion. The City would benefit from having their services through the bid and construction phases, <br />given their familiarity with all of the design elements for these projects. YEI has demonstrated its ability <br />to meet the City’s expectations, and staff is confident they will continue to provide services that meet the <br />City’s standard for excellence in government operations. <br />Staff recommends approval and authorization for the City Manager to execute a four-year Agreement for <br />Services with YEI Engineers, Inc. in an amount not to exceed $600,000. <br />7.D. - Page 2 of 32 <br />165
