As a member of OMNIA (membership ID # 5207277), the City <br />is eligible to utilize contracts sourced through OMNIA’s website when they meet the requirements of <br />Section 2.67.1 of the City’s Municipal Code. <br />In its research, staff identified twelve furniture manufacturers, including Herman Miller, to which various <br />public agencies recently awarded purchase agreements following competitive procurement efforts. All of <br />these agreements are available through OMNIA for use by other public agencies. All of the agreements <br />are active and will remain effective through the end of 2029. <br />Furniture manufacturers servicing large-volume commercial customers, such as the City, do not typically <br />sell directly to the consumer but rather rely on networks of regional dealers that provide design and <br />installation services as a turn-key solution for the end-user. Customers seeking to use the discounted <br />pricing schedules established in the OMNIA contracts must go through these authorized regional dealers <br />to obtain products. Pivot Interiors, Inc. (Pivot) is the closest authorized dealer of Herman Miller furniture <br />in the Northern California region , and the only supplier known to staff that can supply all twelve brands <br />available through the OMNIA platform, along with the required design and installation services. <br />ANALYSIS <br />Staff have utilized Pivot for the design and purchase of goods in the past, and they have met the City’s <br />high standard of performance. Pivot has expressed its willingness to honor the pricing schedules of the <br />existing OMNIA contracts for the supply of furniture. All existing agreements were subject to competitive <br />procurement processes intended to secure the best possible products at the lowest possible prices, <br />thereby meeting the requirements of Section 2.67.1(B) of the City’s Municipal Code. Leveraging twelve <br />contracts through a single supplier is an innovative approach to meeting the City’s needs efficiently, while <br />meeting the requirements of the Municipal Code. <br />PWS will serve as the administrator of the contract, as staff will primarily use it for projects funded through <br />the Tenant Improvement Program. PWS may also assist City departments with small-scale furniture needs <br />funded through their operating budgets, as contract funding allows. However, Tenant Improvement <br />projects shall take priority. <br />Staff recommend approval and authorization for the City Manager to execute a four-year Agreement for <br />Services with Pivot Interiors, Inc. in an amount not to exceed $1,200,000. The not-to-exceed amount <br />requested by staff is intended to establish a ceiling for spending over the four-year period and promote <br />operational efficiency. However, the total spending could be substantially lower as the City’s needs will <br />vary over the life of the contract, and the City does not have a minimum spend obligation. <br />8.M. - Page 3 of 40 <br />649
