All riders of electric mobility devices, with the exception of class 1 and 2 electric bicycles, must <br />be 16 years or older. <br />J. Riders on class 3 electric bicycles must be 16 years or older. <br /> <br />Sec. 8.5. – PARKING <br /> <br />It shall be unlawful to block a sidewalk or park, stand, or leave an electric mobility device, <br />non-motorized mobility device or bicycle on the sidewalk or street at any place within a <br />business district of the City, as such business district is established by the City Zoning <br />Ordinance, except when any such device is placed in a rack or stand provided for such <br />purpose at various places within the business district. <br /> <br />Sec. 8.6. – RACING <br /> <br />No person riding or operating an electric mobility device, non-motorized mobility device, or <br />bicycle upon a public highway, street, or in any public area shall participate in any race, speed <br />event, endurance event, or similar contest unless same has been permitted pursuant to City Code <br />Section 33A. by the City Council or the Chief of Police or designee. <br /> <br />Sec. 8.7. – TRICK RIDING <br /> <br />While riding or operating an electric mobility device, non-motorized mobility device, or bicycle <br />upon a public highway, street, or in any public area, as may be specifically permitted in this <br />Chapter, all wheels shall remain in contact with the roadway. Riding may not be done in a reckless <br />or dangerous manner or in a way that endangers property or pedestrians. <br /> <br />Sec. 8.8. – TAMPERING WITH MANUFACTURER SERIAL NUMBER <br /> <br />No person shall remove, destroy, mutilate, or otherwise alter the serial number permanently <br />stamped or cast on any electric mobility device, non-motorized mobility device, or bicycle. <br /> <br />Sec. 8.9. – PENALTIES FOR VIOLATION <br /> <br />A. Violations of this Article shall be punishable as infractions as follows: <br />1. The penalty for a first violation of this Article is fifty dollars ($50.00). <br />2. The penalty for a second violation of this Article is seventy-five dollars ($75.00). <br />3. The penalty for a third and subsequent violation(s) of this Article is one hundred dollars <br />($100.00). <br />B. Notwithstanding this Section, a police officer may issue a citation for any offense in <br />his/her/their discretion for violations of the California Vehicle Code. <br />C. If this Article is violated by a person who is an unemancipated minor, the parent or legal <br />guardian having control or custody of the minor shall be jointly and severally liable with the <br />minor for the amount of any fine imposed pursuant to this subdivision. <br />Sec. 8.10. – 8.19. – RESERVED <br />9.A. - Page 10 of 10 <br />785
