Public agency personnel operating or riding an electric mobility device, non-motorized <br />mobility device, bicycle, or other similar mobility device as part of, and within the scope <br />of, official duties. <br /> <br />Sec. 8.4. – EQUIPMENT AND RESTRICTIONS <br /> <br />A. All electric mobility devices and bicycles must be equipped and operated in compliance with <br />all State laws, including the California Vehicle Code. <br />B. All persons under the age of 18 operating or riding as a passenger on an electric mobility <br />device or a bicycle must wear a properly fitted and fastened helmet. All persons operating a <br />Class 3 electric bicycle must wear a helmet regardless of age. <br />C. Pursuant to Vehicle Code Section 21201, all bicycles, including electric bicycles, must: <br />1. Be equipped with a brake that will enable the operator to make one braked wheel skid <br />on dry, level, clean pavement at all times while operating the device. <br />2. Be equipped with handlebars so raised that the operator do not have to elevate <br />his/her/their hands above the level of the shoulders in order to grasp the normal steering <br />grip area. <br />3. When operating during darkness, must be equipped with: <br />a. A lamp emitting a white light that, while the device is in motion, illuminates the <br />highway, or bikeway in front of the rider and is visible from a distance of 300 feet in <br />front and from the sides. <br />b. A red reflector or a solid or flashing red light with a built-in reflector on the rear that <br />shall be visible from a distance of 500 feet to the rear when directly in front of lawful <br />upper beams of headlamps on a motor vehicle. Class 2 and Class 3 electric bicycles <br />are required to have a rear red light. <br />c. A white or yellow reflector on each pedal, shoe, or ankle visible from the front and <br />rear of the bicycle from a distance of 200 feet. <br />d. A white or yellow reflector on each side forward of the center of the bicycle, and a <br />white or red reflector on each side to the rear of the center of the bicycle, except that <br />bicycles that are equipped with reflectorized tires on the front and the rear need not <br />be equipped with these side reflectors. The reflectors and reflectorized tires shall be <br />of a type approved by the California Department of Transportation. <br />e. A lamp or lamp combination, emitting a white light, attached to the operator and <br />visible from a distance of 300 feet in front and from the sides of the bicycle, may be <br />used in lieu of the requirements in subsections 8-4(C)(3)(a) above. <br />f. An electric bicycle shall comply with Section C(3)(b) above during all hours. <br />4. No person shall operate an bicycle that is of a size that prevents the operator from safely <br />stopping, supporting the device in an upright position with at least one foot on the <br />ground, and restarting it in a safe manner. <br />D. Riding on an electric mobility device, non-motorized mobility device, or bicycle by more than <br />one person is unlawful unless the vehicle was designed specifically to accommodate more <br />than one person. It is unlawful to transport a passenger on an electric mobility device, non- <br />motorized mobility device, or bicycle designed for a single person. <br />E. All electric mobility devices, with the exception of electric bicycles, shall have a speed limit of <br />15 miles per hour. <br />F. Low-speed vehicles as defined in Section 8.2 shall have a speed limit of 25 miles per hour. <br />G. Class I and II electric bicycles shall have a speed limit of 20 miles per hour. <br />H. Class III electric bicycles shall have a speed limit of 28 miles per hour. <br />9.A. - Page 9 of 10 <br />784
