ATTY/RESO.0024/PC RESO 901 EL CAMINO <br />REV: 04-11-25 VR <br />Page 2 of 27 <br />3.Approval Letter & Conditions in Building Permit Plans -The Applicant shall printthe Notice <br />of Final Decision, with the accompanying conditions of approval, and Mitigation, <br />Monitoring, and Reporting Program provided in the Consistency Checklist for this Project, <br />dated, April 1, 2025, and as listed in Attachment 1 of the Conditions of Approval, on the <br />first page of the building permit plans. [COA][PLANNING] <br />4.Land Acquisition -This approval is dependent upon the Applicant voluntarily obtaining fee <br />title interest to all property necessary for development of the Project as shown on the <br />approved plans and Vesting Tentative Parcel Map prior to final Parcel Map recordation. This <br />includes, but is not limited to, the relevant parcels as specified in the Development <br />Agreement and Vesting Tentative Parcel Map from the City and the Property Transfer <br />Agreement with Peninsula Corridor Joint Powers Board. The Applicant' s fee title interest in <br />the property, including abandoned right of way, shall be demonstrated by a deed(s) <br />conveying the fee title interest to applicant, judgement in quiet title, and/or a property <br />transfer agreement with the Joint Powers Board. With the exception of necessary pre- <br />construction due diligence activities and studies, no construction or related ground <br />disturbing activity (as determined by the City), including but not limited to, utility work and <br />grading may occur until the Applicant has secured fee title to all property necessary for <br />development of the Project. If the Applicant fails to secure said fee title, then the Project, <br />as approved herein, cannot proceed. The Applicant shall provide any and all assurances, <br />including a waiver and indemnity, the City requires in order to convey any of its interest in <br />property necessary for Project development. The Applicant shall reimburse the City for all <br />costs and expenses associated with securing fee title interest in property necessary for <br />Project development, including attorney's fees. [COA][ENGINEERING] <br />5. Right of Way Abandonment - As part of the approval of a Parcel Map, the public rights of <br />way along Winklebleck and California Streets as identified on the Vesting Tentative Parcel <br />Map will be vacated as conditioned by the Vesting Tentative Parcel Map, and by these <br />conditions of approval, and applicant shall have secured fee title interest, as required by <br />Condition of Approval 4. <br />6.Allowed Use -The Project is entitled by right to the permitted use of officeinthe Downtown <br />Precise Plan (DTPP) Downtown General Use Zone, and is conditionally permitted to the <br />Research and Development, Laboratory uses under the approved Use Permit. <br />Notwithstanding permitted uses in the district where the project is located, only land uses <br />reviewed and approved in this application are permitted for the project location. Any <br />change in use beyond the permitted uses in the district are subject to review and approval <br />by the City.[COA][PLANNING] <br />7.Parking – The proposed Project shall include a minimum of at least 342 below ground <br />parking spaces, which includes electric vehicle charging spaces as required by Conditions of <br />Approval #29. [COA][PLANNING] <br />8.Teen Center Parking –All Teen Center staff, including City and City contracted staff, shall <br />be allowed to utilize the off-street parking spaces for the project and be given parking <br />passes or other appropriate access materials during operation of the Teen Center.
