Fees –The Applicant shall pay all Project fees as required by the Development Agreement. <br />[SDR][PLANNING] <br />19.Cost Recovery Fees -The Applicant shall pay all cost recovery fees and replenish the <br />evergreen account as determined by the Community Development Director to ensure funds <br />are available to complete processing of project elements such as an affordable housing <br />plan, Development Agreement, or MMRP. Notice of Fees Protest – Protests of any fees, dedications, reservations, or other exactions <br />imposed by the City as part of the approval or as a condition of approval of the project <br />pursuant to California Government Code Section 66020 and shall be filed within 90-days <br />from the date of the project approval. Water-Efficient Landscaping –The Applicant shall provide to the Planning Manager at the <br />time of building application for vertical development a complete landscaping and irrigation <br />plan conforming to the California Water-Efficient Landscape Ordinance (AB 1881), including <br />an automatic irrigation system (drip, micro-spray, or bubblers) with a rain sensor, and show <br />these measures on the building permit plans. [COA][PLANNING] <br />22.Tree Survey -The Applicant shall provide a tree survey to the Planning Manager that <br />identifies species, location, diameter at breast height (DBH), condition, and critical root <br />zone prior to building permit issuance. Tree Protection -The Applicant shall provide tree protection measures for ordinance-sized <br />trees near the Project and show these measures on the building permit plans prior to <br />building permit issuance. Tree Removal Permit - The Applicant shall obtain a Tree Removal Permit from the City Parks <br />and Recreation Director prior to the removal and/or and tree trimming of all ordinance-size <br />trees as defined within the City’s Tree Preservation Ordinance prior to building permit <br />issuance and as shown on the approved plans and in the Arborist Report prepared by H.T. <br />Harvey and Associates dated October 7, 2024 which includes the tree number, type, and <br />location. Street Trees - A total of 37 (24-inch box) street trees shall be planted by the Applicant along <br />the El Camino Real (12), James Street (10), Winklebleck Street and Franklin Street (15) <br />frontages as well as an additional 5 trees in the plaza and 39 trees in the creek area, for a <br />grand total of 81 trees.
