No federally- <br />listed animal species are known to occur on or <br />proximal to the site within San Mateo County or <br />the City of Redwood City. The project site does <br />contain several trees and shrubs suitable for <br />nesting bird species. This vegetation would be <br />removed to accommodate the project. Nesting <br />birds are protected under the Migratory Bird Treaty <br />Act (MBTA). CONSTRUCTION PRACTICE: As <br />required by Redwood City General Plan Programs <br />NR-22 (Sensitive Species Identification) and <br />Program NR-48 (Tree Planting): Conducting pre- <br />construction nesting bird surveys if vegetation <br />removal would occur during nesting season, which <br />is defined as February 1 through August 31 of each <br />year would address these impacts to nesting birds <br />and is part of the project. <br />National Historic Preservation Act of 1966, <br />particularly sections 106 and 110; 36 CFR Part <br />800 <br />A finding of No Effect on historic properties as <br />provided in 36 CFR part 800.4(d)(1) is <br />recommended for this Project and no impacts to <br />archaeological resources were identified. <br />CONSTRUCTION PRACTICE: As part of the project in <br />the event of accidental discovery, the City will, per <br />Redwood City General Plan Program BE-106 <br />''Cultural Resource Management Plan'', conduct <br />further coordination activities with local tribal <br />contacts as needed, and the Project Proponent <br />(Sand Hill Property Company) will implement the <br />accidental discovery recommendations provided in <br />the Phase I XPI, Section 6.2. <br />Project Mitigation Plan <br />CONSTRUCTION PRACTICE: Project proponent (Sand Hill Property Company) will conduct a pre-construction <br />nesting bird surveys and removing trees outside the nesting bird season (February 1 through August 31 of <br />each year).
