maintenance and operation of the New Levee and certain other Seaport Centre wet utility <br />improvements; and <br />WHEREAS, construction of the New Levee Improvements is now complete, the <br />New Levee has been accredited by FEMA, and City is ready to accept ownership of the <br />New Levee Improvements and the grant of new public service levee easements for the <br />Seaport Plaza Levee Improvements and those portions of the upgraded New Levee <br />Improvements that were not covered by the 1986 Levee Easements ("New Levee <br />Easements"); and <br />WHEREAS, HCP is granting to City the portion of the New Levee Easements and <br />the New Levee Improvements located within the HCP Seaport Centre and Seaport Plaza <br />and MetLife is granting to City the portion of the New Levee Easements and the New <br />Levee Improvements located within the MetLife Seaport Centre; and <br />WHEREAS, given the completion of the New Levee Improvements and granting <br />of the New Levee Easements and New Levee Improvements, City has determined it has <br />no need for portions of (i) the Original Seaport Centre Levee Improvements and (ii) the <br />1986 Levee Easements, including the portion located along the inboard boundary with <br />Seaport Plaza; and <br />WHEREAS, pursuant to Sections 8300 et seq. of the California Streets and <br />Highways Code, HCP, Met Life and SCOA have requested that the City Council <br />summarily vacate its public service levee easement with respect to the Levee Vacation <br />Area (defined below) ("Levee Vacation Area Easement"). "Levee Vacation Area" means <br />the portions of the 1986 Levee Easement Area described in Exhibit A and depicted in <br />Exhibit A-1 through Exhibit A-6; and <br />WHEREAS, City staff has reviewed and recommends approval of the proposed <br />summary vacation of said Levee Vacation Area Easement; and <br />WHEREAS, on October 26, 2020, by Resolution No. 15900, the City Council <br />approved the Levee Financing and Improvement Agreement and, in connection therewith, <br />determined that the New Levee project is categorically exempt under Sections 15301, <br />15302 and 15304 of the State CEQA Guidelines, 14 CCR §§ 15000, et seq.; and <br />WHEREAS, similarly, the approval of the summary vacation of the Levee Vacation <br />Area Easement, is categorically exempt under Sections 15301, 15302 and 15304 of the <br />State CEQA Guidelines, 14 CCR §§ 15000, et seq. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />1.
