to be bound by the requirements of Section 4(b) of this Contract through the entire Term <br />of this Contract, including any renewal terms. <br />b) Owner shall maintain and preserve the Historic Property and its character defining <br />features throughout the Term of this Contract according to certain standards and <br />requirements. Such standards and requirements include the City Minimum Standards; the <br />Secretary's Standards; the OHP Rules and Regulations; the State Historical Building Code <br />as determined applicable by City; Chapter 40 of Redwood City Code; all applicable <br />building safety standards; and the requirements of City's Planning Manager, Historic <br />Resources Advisory Committee, Planning Commission and City Council. Character <br />defining features include, but are not necessarily limited to, the general architectural form, <br />style, materials, design, scale, details, mass, roof line and other aspects of the appearance <br />of the exterior and interior of the Historic Property. All maintenance and preservation <br />required by this paragraph shall be performed at Owner's own cost and expense. <br />C) Owner shall, whenever necessary throughout the Term of this Contract, restore <br />and rehabilitate the Historic Property to conform to the City Minimum Standards; the <br />Secretary's Standards; the OHP Rules and Regulations; the State Historical Building Code <br />as determined applicable by City; Chapter 40 of the Redwood City Code; all applicable <br />building safety standards; and the requirements of City's Planning Manager, Historic <br />Resources Advisory Committee, Planning Commission and City Council. All restoration <br />and rehabilitation required by this paragraph shall be performed at Owner's own cost and <br />expense. <br />d) Owner shall allow reasonable periodic examinations, by prior appointment, of the <br />interior and exterior of the Historic Property by representatives of the County Assessor for <br />the County of San Mateo, the California Department of Parks and Recreation, the <br />California Board of Equalization, the Historic Resources Advisory Committee, City, and <br />any other appropriate governmental agency, as may be necessary to determine owner's <br />compliance with the terms and provisions of this Contract. In any event, there shall be at <br />least one inspection every five years by City's Planning Manager and his/her designee. <br />The first such inspection must occur within five years of the date of this agreement. <br />e) Owner agrees to provide City with a report as to the status of the Historic Property <br />annually by January 31 of each year, which annual report shall provide substantiation <br />reasonably satisfactory to City's Planning Manager that Owner is in compliance with the <br />Contract. Such annual report will be on a form approved by the City's Planning Manager <br />and furnished to Owner by City. <br />f) Owner hereby agrees to and will comply with all applicable local, state, and federal <br />statutes, regulations, rules, codes (including building codes), ordinances, and other <br />requirements of governmental authorities now or hereafter in effect ("Applicable Laws") <br />pertaining to the use of the Historic Property. Owner must give City immediate written <br />notice on Owner's becoming aware that the use or condition of the Historic Property is in <br />violation of any Applicable Law. <br />g) Owner or agent of Owner shall provide written notice of the contract to the <br />California Office of Historic Preservation within six (6) months of entering into this <br />Contract. <br />REV: 10-23-25 VR <br />ATTY/AGR.2025.285/Mills Act Contract (979 Arlington Road) (Page 3 of 11) <br />
