REV: 2-24-26 LR Alterations and Improvements No improvements or alterations shall be made in, to, or upon the Garages, or any appurtenances thereto, by Consultant without the prior written consent of the City Engineer or their designee. No signs, directional, guiding and other stripes, lines, direction and markings shall be installed or painted in or upon the Garages or removed by Consultant without the prior written consent of City Engineer or their designee. Additional Reports In addition to the reports required by other provisions of this Agreement, Consultant shall, upon request in writing by the City Engineer or their designee, submit and file with the City Engineer or their designee, in such form as specified by the City Engineer or their designee, reports and information relating to costs and expenses of operation and maintenance of the Garages; charging, collection of and amount of parking fees collected by Consultant; procedures followed by Consultant; and other matters relating to the operation and custodial maintenance of the Garages and Consultant's performance under this Agreement. The additional reports shall include, but not be limited to, quarterly reports on inventory, rates, utilization, and other operating data as determined by the City Engineer or their designee. Rules & Regulations The City Engineer or their designee shall have the right to establish, and the Consultant shall adhere to any reasonable rules, regulations, or instructions relating to the operation and maintenance of the Garages, the charging and collection of fees, procedures for payment of monies to City, reports and the contents thereof to be prepared and submitted by Consultant to City, and other matters related to the Garages and their operation and maintenance. Damage or Destruction Any termination actions for the damage or destruction of the facility shall follow the terms identified in section 21 of the agreement. Prior Authorized Work Reconciliation Since 2022, the Garages have required increased services and maintenance beyond the estimated amount in the ACE contract. Additional work not included in the Initial Term Agreement consists of: Upgrading and maintaining the security systems, Preventative maintenance and repair services for lighting, door locks, emergency call system and neon signage, and Non-warranty repairs. This Agreement shall include a payment to Consultant of $364,895.00 for authorized additional work and payment for services provided in 2025. Consultant shall submit an invoice to the City for this work and such invoice shall be paid per the terms of this Agreement. ATTY/AGR.2026.049/ACE Parking Inc.
