has determined that the Affordable Housing Project at the Affordable Site complies with the City's
<br />development standards, the plans and policies set forward in the General Plan, and meets the
<br />requirements of the City's Affordable Housing Ordinance. The 901 EI Camino Real Project and
<br />Affordable Housing Project plans, approvals, and determinations described in this Recital are
<br />collectively referred to herein as the "Project Approvals." These Project Approvals include:
<br />1. As further described in Recitals K and L above, on June 26, 2023, by
<br />adopting Resolution No. 16153, the City Council certified the DTPP SEIR, approved the DTPP
<br />Plan -Wide Amendments, adopted CEQA Findings of Fact, a Statement of Overriding
<br />Considerations, and the DTPP Plan -Wide Amendments MMRP;
<br />2. On April 28, 2025, and as set forth in City Resolution Nos. 16298 and
<br />16295, the City Council considered the CEQA Guidelines Section 15183 Consistency Checklist
<br />For the 901 EI Camino Real Project and Affordable Housing Project, dated September 13, 2024,
<br />and its findings prepared by the City's Planning Division (collectively, the "Consistency
<br />Checklist"), the DTPP EIR and the DTPP SEIR and DTPP Plan -Wide Amendments MMRP as
<br />well as the Housing Element UpdateEIRand Housing Element Update MMRP, as recommended
<br />by the Planning Commission on April 15, 2025, in Resolution No. 25-02 in connection with the
<br />Project Approvals, and in Resolution No. 25-01 in connection with the Affordable Housing Project
<br />approvals, and determined that there are no environmental effects which are peculiar to the 901 El
<br />Camino Real Project, the Property, the Affordable Housing Project and Affordable Site, nor are
<br />there any new significant effects, potentially significant off-site impacts or cumulative impacts, or
<br />substantial new information which was not known at the time of the DTPP FIR and DTPP SEIR
<br />or Housing Element Update EIR that identifies any significant effects that were not already
<br />identified and analyzed in the certified DTPP EIR and DTPP SEIR or Housing Element EIR;
<br />3. On April 28, 2025,.by City Resolution Nos. 16299 and 16300, the City
<br />Council approved General Plan and DTPP Amendments specific to the 901 EI Camino Real
<br />Project;
<br />4. On August 13, 2024, pursuant to the Surplus Land Act (Government Code
<br />Sections 54220 et seq.), the State of California Department of Housing and Community
<br />Development determined that the portions of California Street and Winklebleck Street that are
<br />proposed to be vacated was found to be exempt surplus land pursuant to Government Code Section
<br />5422 1 (f)(1)(B) as the City Parcel is less than one-half acre and is not contiguous to land owned by
<br />a state or local agency that is used for open space or low- and moderate -income housing purposes;
<br />5. On April 28, 2025, as set forth in City Resolution No. 16301, the City
<br />Council approved a VTPM, a Downtown Planned Community Permit, and Use Permit, a Planned
<br />Development Permit, subject to the conditions of approval applicable to the Project ("Conditions
<br />of Approval"), and also approved an Affordable Housing Plan authorizing the alternative
<br />compliance with the Affordable Housing Ordinance, approved the Relocation Plan and the
<br />Affordable Housing Partner as a qualified designee, and approved the Affordable Housing Land
<br />Donation Agreement and land donation contemplated thereunder; and
<br />6. On April 28, 2025, as set forth in City Resolution No. 16296 and in
<br />connection with approving the development of the Affordable Housing Project at the Affordable
<br />ATTY/AGR/2025.085 —901 EL CAM INO REAL DA
