3. The Grantee covenants and agrees, for itself and its successors and assigns, that there shall <br />be no discrimination against or segregation of any person or group of persons on account <br />of race, color, creed, religion, sex, sexual orientation, age, marital status, national origin, <br />or ancestry in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoyment of the <br />Property, nor shall the Grantee itself or any person claiming under or through it establish <br />or permit any such practice or practices of discrimination or segregation with reference to <br />the selection, location, number, use or occupancy of tenants, lessees, subtenants, sublessees <br />or vendees in the Property and the Improvements thereon. <br />4. The Grantee hereby agrees and acknowledges that, as of the date of recordation of this <br />Grant Deed, the Property is subject to that certain "Irrevocable Offer to Dedicate", to be <br />recorded concurrently herewith, under which Grantee is required to irrevocably offer for <br />dedication the Property to the City or to a City Qualified Designee upon certain terms and <br />conditions set forth in the recorded Irrevocable Offer to Dedicate The Grantee and Grantor <br />further acknowledges that such Irrevocable Offer is a separate instrument and at any time <br />the Irrevocable Offer to Dedicate has terminated in accordance with its terms, the Property <br />shall no longer be subject to the provisions of the Irrevocable Offer to Dedicate, without <br />affecting the validity or continued effect of this Grant Deed. <br />5.
