REV: 07-10-25 VR <br />1. Term and Termination <br />1.1 Term <br />The MOU shall be effective immediately upon signature of all the Parties. Unless <br />terminated earlier pursuant to this section, the term of the MOU is from June 23, 2025 <br />through June 23, 2026. <br />1.2 Termination <br />Any party upon tendering sixty (60) days written notice to the other parties may <br />terminate this MOU. <br />2. Continuing Status of Director Monaghan as Employee of County <br />2.1 The Parties acknowledge and agree that at all times the services and <br />actions performed under this MOU by Director Monaghan are conducted in his capacity <br />as an employee of the County. Director Monaghan continues to be a Chief Inspector of <br />the San Mateo County District Attorney’s Office, continues to be a member of the <br />workforce of the San Mateo County District Attorney’s Office, and remains an employee <br />of the County while providing services to the Interjurisdictional Program. At no time shall <br />Director Monaghan be deemed an employee of the City. Neither the County nor Director <br />Monaghan acquires any of the rights, privileges, powers, or advantages of the <br />employees of the City. <br />2.2 Director Monaghan will determine the method, details, and means of <br />performing the services under this MOU. The City shall not have the right to, and shall <br />not, control the manner or determine the method of accomplishing Director Monaghan’s <br />services. <br />2.3 Director Monaghan does not fall under the chain-of-command of the <br />Redwood City Police Department. <br />2.4 In the event that Director Monaghan is determined by a court of competent <br />jurisdiction or CalPERS to be eligible for enrollment in CalPERS as an employee of <br />City, County shall hold the City harmless for any claims, damages, losses, or payments <br />arising out of or related to loss of retirement status, and County shall indemnify, defend, <br />and hold harmless City for the payment of any employee and/or employer contributions <br />of CalPERS benefits on behalf of Director Monaghan, as well as for the payment of any <br />penalties and interest on such contributions, which would otherwise be the <br />responsibility of City. County understands and agrees that Director Monaghan is not, <br />and will not be, eligible for memberships in, or any benefits from, any City group plan <br />for hospital, surgical or medical insurance, or for membership in any City retirement <br />program, or for paid vacation, paid sick leave, or other leave, with or without pay, or for <br />any other benefit which accrues to a City employee. <br />ATTY/AGR.2025.170/County of San Mateo (MOU Between RWC and SMC for Ryan Monaghan) (Page 2 of 8)
