Preliminary Draft for City Review <br />Relocation Appeal Policy and Process <br />November 2025 <br />Page | 2 <br />Step 3: Appellant Seeks a Relocation Appeal Hearing <br />The City’s Relocation Appeal process should allow the Appellant to submit a request to appeal <br />without being required to utilize legal counsel or even their Relocation Advisor. 49 CFR 24.10 <br />outlines the City’s regulatory obligations under the Uniform Relocation Act. <br />A.The Appellant should have information on the City’s Relocation Appeal Process from prior <br />notices so that the Appellant can appeal directly to the City at any time. Note that not all <br />appeals are generated by the denial or partial denial of a relocation claim. <br />B.Ideally, the Appellant will work with their Relocation Advisor who can help the Appellant <br />navigate the appeal process. <br />C.Immediately upon request, the Relocation Advisor shall provide the Appellant with the <br />current Relocation Appeal FAQ that includes the City ’s Appeal Coordinator ’s contact <br />information. <br />D.The Appellant (with or without Relocation Advisor assistance) may submit a written request <br />to file an appeal to the City’s Relocation Appeal Coordinator. The form of the written request <br />shall be via electronic mail or USPS First Class Mail. <br />E.The Relocation Appeal Coordinator will respond to the Appellant in writing via electronic <br />mail and USPS First Class Mail within 15 days to acknowledge receipt of the request to file <br />an appeal and to facilitate Appeal Hearing (Exhibit F). The response shall include: <br />1)The Relocation Appeal Coordinator’s contact information, <br />2)Options for initial appeal hearing with Appeal Hearing Officer. (Virtual or In Person) <br />3)Relocation Appeal FAQ (Exhibit C) <br />F.Relocation Appeal Coordinator: <br />1)Primary contact and initial written response to the Appellant. <br />2)Coordinates room/virtual meeting/participants. <br />3)May be required to coordinate court reporter, interpreter, security staff. <br />Step 4: Facilitate an Appeal Hearing. <br />The Appeal Hearing Script presented as Exhibit G provides a framework for the hearing. <br />Attendees: <br />1)Appellant <br />2)Appellant Representative <br />3)Relocation Appeal Coordinator <br />4)Relocation Appeal Hearing Officer <br />5)Relocation Advisor <br />6)City Staff Upon Request <br />7)Court Reporter (optional) <br />Appendix D to Relocation Impact Memorandum <br />ATTY/RESO.0015/CC RESO APPROVING THE RELOCATION IMPACT MEMORANDUM FOR THE 84/101 REIMAGINED PROJECT - EXHIBIT A <br />REV: 04-20-26 VR <br /> <br /> <br />Page 23 of 34
