Preliminary Draft for City Review <br />Relocation Appeal Policy and Process <br />November 2025 <br />Page | 1 <br />Any aggrieved person may file a written appeal with the agency in any case in which the person <br />believes that the agency has failed to properly consider the person's application for assistance <br />under this part. Such assistance may include, but is not limited to, the person's eligibility for, or the <br />amount of, a payment required under § 24.106 or § 24.107, or a relocation payment required under <br />this part. The agency shall consider a written appeal regardless of form. (49 CFR 24.10) (Exhibit A) <br />Step 1: Prepare and Approve a Relocation Appeal Policy <br />ARWS will Prepare a Relocation Appeal Policy (Policy) for the City’s review and approval. The Policy <br />will include a detailed Standard Operating Policy to guide the City’s implementation of an appeal, <br />and summary Policy language (Policy Summary) for outward facing documents. The City should <br />A.Route the Policy internally to ensure compliance with existing City appeal policies. <br />B.Include the Policy Summary in the Relocation Plan if one is prepared by the City. <br />C.Include the Policy Summary (Exhibit B) in all outward facing Relocation handbooks, notices, <br />claim denial letters, and Relocation Appeal FAQ. <br />D.Establish roles and responsibilities <br />1)Relocation Advisor <br />2)Relocation Appeal Coordinator <br />3)Hearing Officer. The Relocation Appeal Hearing Office shall be either the head of the <br />City or his or her authorized designee. However, the Hearing Officer shall not have <br />been directly involved in the action appealed. (49 CFR 24.10(h)) <br />Step 2: If City Denies a Relocation Benefit <br />The genesis of an appeal may be: <br />A.A response to the City’s determination that a person is or is not a displaced person eligible <br />to receive assistance under the City’s Relocation Assistance Program, or <br />B.A response to the City’s denial in full or in part of a request for reimbursement for relocation <br />expenses (relocation claim) <br />If the City determines to rescind a person’s eligibility as a displaced person, the City shall provide <br />that person with a Notice to Rescind a Notice of Eligibility (Exhibit C). That Notice shall include a <br />Relocation Appeal FAQ (Exhibit D). <br />If the City denies a relocation claim in full or in part, it shall provide that person with a Notice of <br />Denial (or Partial Denial) (Exhibit E).
