Exhibit MM — Site Plan With 15-Foot Visibility Triangles <br />(Architectural Plans Submitted With Permits) <br />February 2022 — submitted to the City as part of Permits ADU22- <br />0064 and C22-0027 (filed November 2022) <br />Issue. The Amended Citation of March 24, 2026 alleges as Violation 3 <br />that the property is non-compliant with the City’s 15-foot visibility <br />triangle at the corner. Respondents’ position is that the visibility-triangle <br />geometry was already drawn into the architectural plans Respondents <br />submitted with their permit applications in November 2022 — the same <br />permits the City has held in plan check for forty-one months. Respondents <br />identified the issue and addressed it themselves at the time of submission. <br />Significance. Violation 3 is bifurcated to a separate proceeding by the City <br />Attorney’s letter of April 27, 2026 and is not on the Council agenda for <br />May 4. This exhibit is included for the limited purpose of establishing one <br />fact relevant to V1 framing in Section 4: the visibility triangle was not an <br />oversight by Respondents that the City discovered and added to the <br />citation. The triangles are drawn on the plans the City has been sitting on <br />since November 2022. The leverage pattern Section 4 describes — V2 and <br />V3 used as leverage to keep V1 unresolved — is illustrated by the very <br />plans Respondents submitted before any of this began.
