The City’s Public Works Division (Linda Chang) committed in <br />writing that if Respondents’ work was outside the recorded easement, no <br />corrective demolition was owed and Public Works itself would restore the <br />culvert access. Ms. Chang also approved a specific gate-relocation <br />solution. <br />Significance. This is the first of three written agreements senior City <br />officials reached with Respondents that the City later repudiated. <br />Repudiation came from Senior Assistant City Attorney Lisa Rauch on <br />January 30, 2026: “There is no information to support that Public Works <br />ever agreed to same.” The repudiation is contradicted by Ms. Chang’s <br />own emails. This is the foundation of the pattern: agreement, repudiation, <br />no consistent City position, and Respondents bearing the cost of every <br />iteration while the permits sit in plan check. <br />6.A. - Page 37 of 64 <br />39
