Page 3 of 4 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.org <br />to be performed, shall first make application to the building official and obtain the <br />requirement permit. <br />Under RWC Code 9.40 and Section 105.1 of the Building Code, the owners were required to obtain a <br />permit prior to constructing the garage addition at the Property. As of February 25, 2026, the date Code <br />Enforcement issued Administrative Citation CE19-0399, City records confirm that no valid building permit <br />was on file for the garage addition. Building Permit Number ADU22-0064, submitted on November 7, <br />2022, by Golden State Design Builders on behalf of the property owners to legalize an accessory dwelling <br />unit and resolve the code violations, expired on October 22, 2025, due to inactivity. A screenshot <br />confirming the expiration is attached as Attachment E. <br />The unpermitted garage addition remains on the Property. <br />Stephen and Sharon Burns submitted an appeal brief for Council’s consideration. Their appeal brief is <br />attached as Attachment F. <br />EQUITY IMPACT STATEMENT <br />The outcome of this appeal will have no significant impact on the City’s equity goals. <br />FISCAL IMPACT <br />There is no significant fiscal impact from this appeal and its outcome. <br />ENVIRONMENTAL IMPACT <br />This appeal is not a project under the California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. Additionally, notice was provided to the property owners at least 10 days prior <br />to the appeal hearing and a copy of this staff report was provided to the owners five days in advance of <br />the appeal hearing. <br />6.A. - Page 3 of 64 <br />5
