(See Attachment C.) Redwood Creek and its bank abut and run parallel <br />to the PUE. Redwood Creek is part of the City’s stormwater drainage system. <br />In May 2019, Code Enforcement opened case no. CE19-0399 at the Property due to illegal construction of <br />a garage addition without a permit. The unpermitted garage addition is constructed on the Property <br />nearest the creek. (See Attachment D.) In June 2019, Code Enforcement issued a Notice of Violation <br />(“NOV”) at the Property for, inter alia, violation of RWC Code 9.40 for the unpermitted construction of a <br />garage addition. Further investigation resulted in the issuance of another NOV in February 2020 for <br />violation of RWC Code 9.40 relating to the garage addition. The City issued a Final NOV in June 2021. <br />In 2022, after meeting with staff, Mr. Burns applied for a permit (Building Permit Number ADU22-0064) <br />to attempt to clear the violation by demolishing the unpermitted garage addition and converting the <br />garage into an Accessory Dwelling Unit (ADU). Mr. Burns submitted plans for review. In three cycles of <br />review between February 2023 and April 2025, staff reviewed the plans, which were not approved, <br />providing comments and requesting updated plans in compliance with City regulations. <br />Mr. Burns’ permit application expired on October 22, 2025, due to inactivity and no plans were approved. <br />Mr. Burns has not removed the garage addition and the Property remains out of compliance. (See <br />Attachment D.) <br />On February 25, 2026, Code Enforcement sent to Mr. Burns an Issuance of Administrative Citation and <br />Administrative Citation CE19-0399, citing three (3) violations at $100 each, totaling $300. Code <br />Enforcement subsequently issued to the owners an Amended Issuance of Administrative Citation and <br />Amended Administrative Citation on March 24, 2026, to correct certain clerical errors. <br />In view of existing case law and the CA Building Code, the owners’ appeal of the citation for the <br />unpermitted garage addition in violation of RWC Code 9.40 and the CA Building Code is heard by City <br />Council. The owners’ appeal of the other two violations will be heard by an Administrative Hearing Officer <br />on a later date. <br />ANALYSIS <br />Staff recommend that the City Council uphold Administrative Citation CE19-0399 for violation of RWC <br />Code 9.40 and the CA Building Code because the garage addition at the Property was constructed without <br />a permit. RWC Code 9.40 adopts by reference the 2025 CA Building Codes under Title 24 of the California <br />Code of Regulations, including all applicable building standards. Section 105.1 of the Building Code <br />provides: <br />Any owner or owner’s authorized agent who intends to construct, enlarge, alter, repair, <br />move, demolish or change the occupancy of a building or structure, or to erect, install, <br />enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or <br />plumbing system, the installation of which is regulated by this code, or to cause such work <br />6.A. - Page 2 of 64 <br />4
