<br />ATTY/RESO.0020/CC RESO APPROVING AMENDMENTS TO HPP GUIDELINES – EXHIBIT B <br />REV: 05-04-26 LF <br />Page 63 of 86 <br />(a) An agreement authorizing the Owner to immediately terminate <br />the tenancy of a Qualifying Household occupying an Affordable Unit, where one or more members <br />of that Qualifying Household misrepresented any fact material to the qualification of such <br />household as a Qualifying Household; <br />(b) An agreement providing that each Qualifying Household <br />occupying an Affordable Unit shall be subject to annual certification or recertification of income <br />as a condition to continued occupancy of the Affordable Unit; <br />(c) An agreement providing that each Qualifying Household <br />occupying an Affordable Unit may be subject to rental increases in accordance with this <br />Regulatory Agreement; <br />(d) Providing that the Owner will not discriminate on the basis of <br />race, creed, color, gender, sexual orientation, national origin, ancestry, religion, marital status, age, <br />disability or receipt of public assistance or housing assistance in connection with rental of an <br />Affordable Unit, or in connection with the employment or application for employment of persons <br />for operation and management of the Development, and all contracts, applications and leases <br />entered into for such purposes shall contain similar non-discrimination clauses to such effect; and <br />(e) Providing that the Qualifying Household shall occupy the <br />Affordable Unit as its principal residence and shall not sublease all or part of the Affordable Unit <br />for any purpose. <br />2.9.7 The Owner shall not terminate the tenancy or refuse to renew the lease <br />or rental agreement of a Qualifying Household except for: (i) serious or repeated violations of the <br />terms and conditions of the lease; (ii) because the previously Qualifying Household is no longer a <br />Qualifying Household; (iii) for violation of applicable Federal, State, or local law; or (iv) for other <br />good cause. The Owner shall, in connection with termination of the tenancy of a Qualifying <br />Household or a refusal to renew the lease or rental agreement of a Qualifying Household, serve <br />written notice upon the Qualifying Household specifying the grounds for the action in accordance <br />with all applicable Laws and at least thirty (30) days before the effective date of the termination <br />of the tenancy, unless the termination is pursuant to a legal action in unlawful detainer. <br />2.10 Tenant Selection Policies and Criteria. The Owner shall adopt written tenant <br />selection policies and criteria that: <br />2.10.1 are consistent with the purpose of providing affordable rental housing <br />for Qualifying Households at an Affordable Rent; <br />2.10.2 are reasonably related to tenant eligibility and ability to perform the <br />obligations of the lease for an Affordable Unit; <br />2.10.3 subject to applicable fair housing laws, give reasonable preference for <br />City-restricted units to eligible households that live (or have ever lived),work, or have been offered <br />work in the City of Redwood City. Owner will comply with the local preference requirements <br />outlined in the City’s Affordable Housing Program Guidelines published on the City’s website and <br />incorporated herein by this reference, provided that such preferences may be waived for
