GENERAL PROHIBITION OF OPEN CONTAINERS OF ALCOHOLIC <br />BEVERAGES <br />Sec. 33B.1. PURPOSE: <br />The purpose of this Chapter Article is to regulate the possession and consumption of <br />alcohol in commercial districts within the City for the optimum use and enjoyment of the <br />residents of the City; to establish regulations to promote the safety and comfort of persons <br />who consume alcohol within the commercial districts City as well as persons residing or <br />owning property in, and in the vicinity of, the commercial districts in the City. <br />Sec. 33B.2. DEFINITIONS: <br />For purposes of this Chapter Article, the following words and phrases shall have the <br />meanings respectively ascribed to them by this Section: <br />ALCOHOLIC BEVERAGE: Shall have the meaning ascribed thereto in the Alcoholic <br />Beverage Control Act [1], as the same may from time to time be amended. <br />COMMERCIAL DISTRICTS: The zoning districts designated Central Administration, <br />Neighborhood Commercial, Central Business, General Business, General Commercial, <br />Commercial Park and Central Business Retail Districts in the Redwood City Zoning <br />Ordinance (Ordinance No. 1130, effective July 10, 1964, as amended from time to time). <br />Sec. 33B.3. POSSESSION OF OPEN CONTAINERS OF ALCOHOLIC <br />BEVERAGES PROHIBITED EXCEPT WHERE PERMITTED: <br />It shall be unlawful for any person to have in his or her possession any bottle, can or other <br />receptacle containing any alcoholic beverage which has been opened, or a seal broken, <br />or the contents of which have been partially removed, in any public place or in a place <br />open to the public in the commercial districts, except in the following permitted situations: <br />A.Special activities subject to an encroachment permit pursuant to Sections <br />33A.3 and 33A.41 of this Code; <br />B.Outdoor Business Activity including in Parklets and Sidewalk Ccafes subject to <br />an encroachment permit either authorized pursuant to Section 29.3 Chapter 29 <br />of this Code or pursuant to a conditional use permit pursuant to the Redwood <br />City Zoning Ordinance. <br />1 Bus. & Prof. C. § 23000 et seq.
