The process still allows the appeal officer to request <br />additional and clarifying information from the landlord as well as take into consideration any <br />extenuating circumstances. <br />Public Comment on Administrative Regulations & Fair Rate of Return Appeal Guidelines <br />The draft administrative regulations, FRR appeal guidelines, and FRR appeal form were originally released <br />for a two-week public comment period, but due to feedback from key stakeholders, the comment period <br />was extended to four weeks (March 27 to April 24, 2026). Throughout the comment period, staff sent four <br />emails to various City email listservs notifying residents, landlords, and key stakeholders. During this public <br />comment period, the City received eight (8) comments. <br />Some comments had actionable requests related to the administrative regulations and FRR appeal <br />guidelines. To address these comments, the City edited the administrative regulations and FRR appeal <br />guidelines by clarifying timelines throughout, extending timelines for certain items, and adding an annual <br />reporting section to the administrative regulations. A summary of the feedback received that had <br />actionable requests to the administrative regulations and FRR appeal guidelines is included as Attachment <br />F. Several of the comments received asked for changes to the TPO itself and did not provide direct <br />feedback on the administrative regulations or FRR appeal guidelines. Since changes to the TPO are not <br />being considered at this time, those comments were not included in this summary attachment. Full copies <br />of the public comments submitted during the public comment period are included as Attachment G. <br />Relocation Assistance Administrative Fee <br />The TPO requires landlords terminating a tenancy for a no-fault just cause2 to pay displaced tenants <br />relocation assistance. Landlords are required to pay all tenants covered under the TPO one month’s rent <br />as a direct payment or a waiver of their final months’ rent. Low-income3 or special circumstances4 tenants <br />may qualify for greater relocation assistance payments equal to three (3) to four (4) months of Fair Market <br />Rents5. When tenants receive a notice of termination for no-fault just cause from their landlord, they may <br />submit a relocation assistance application to the City. <br />The City’s TPO authorizes staff to collect an administrative fee from landlords to cover the City’s costs to <br />process the relocation assistance application. It is the general policy of the City to charge for the full costs <br />of services provided by the City when they benefit individual users rather than members of the community <br />as a whole. This fee shall be billed to the landlord once the tenant's relocation assistance application has <br />been approved or denied by the City. <br />2 No-fault just causes include owner-move in, withdrawing the unit from the rental market, unit must be vacated to <br />comply with a court or government order, substantial remodel of the unit, or demolition of the unit. <br />3 Low-Income: Households whose annual income does not exceed eighty (80) percent of the area median income <br />(AMI)) <br />4 Special-Circumstances: low-income households where at least one member is 62 years or older, at least one <br />member qualifies as disabled, there is at least one child under 18 years old who is legally dependent, and/or a <br />household that has occupied their rental unit as their primary residence for 5 or more consecutive years. <br />5 Fair Market Rents are standard rents published by the U.S. Department of Housing and Urban Development <br />annually, calculated as the 40th percentile of gross rents for regular, standard-quality units in a local housing <br />market <br />8.A. - Page 6 of 85 <br />264
