Adoption of the FRR Guidelines helps in establishing a <br />clear and objective process for determining a fair rate of return. <br />To ensure that the impact of the TPO aligns with the intent of the TPO over time, the City will be tracking <br />data on notices of termination for no-fault just cause terminations submitted to the City, relocation <br />assistance applications, tenant/landlord inquiries, fair rate of return appeal applications, City costs for <br />implementation, and fees collected from landlords. In addition, the City will continue to work in close <br />partnership with Project Sentinel to collect additional information on the housing issues residents and <br />landlords are facing. Data on these metrics will be published annually. <br />FISCAL IMPACT <br />The proposed fees represent the cost of administering relocation assistance and fair rate of return appeal <br />services. The fees would be paid by landlords who initiate no-fault just cause terminations resulting in a <br />tenant applying for greater relocation assistance or when landlords submit a fair rate of return appeal. To <br />the extent the City does not fully recover its administrative cost for those services, General Fund dollars <br />will offset the activities. This may require budget amendments for the Housing Division depending on the <br />level of relocation and fair rate of return appeals activity. Costs for the initial implementation and <br />enforcement of the TPO, including staff time and ongoing General Fund expenditure of approximately <br />$25,000 per year for software, and $68,000 per year for Project Sentinel’s services for the Tenant and <br />Landlord Counseling Services Program, have already been factored into the budget. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Pursuant to California Government Code Sections 6062a, notice of the public hearing was published at <br />least 10 days in advance and was published twice in the San Mateo Daily Journal with at least five days <br />between publications. Public notification was also achieved by posting the agenda, with the agenda items <br />being listed, at least 72 hours prior to the meeting. <br />As noted above, the City also held a four-week public comment period on the draft administrative <br />regulations and FRR appeal guidelines, which were shared with the community through several of the <br />City’s email listservs, including the Anti-Displacement Strategy list, housing newsletter list, a landlord <br />contact list include all landlords that hold business licenses. The draft administrative regulations and FRR <br />appeal guidelines were also shared with key stakeholders including the California Apartment Association. <br />8.A. - Page 8 of 85 <br />266
