A property containing 2 separate dwelling units within a single structure in <br />which the owner occupied 1 of the units as the owner's primary residence at <br />the beginning of the tenancy, so long as the owner continues in occupancy, <br />and neither unit is an accessory dwelling unit or a junior accessory dwelling <br />unit. <br />7. Housing that has been issued a certificate of occupancy within the previous <br />15 years, unless the housing is a mobilehome. <br />8. Rental unit, including a mobilehome, that is alienable separate from the title <br />to any other dwelling unit, provided that the following applies: <br />i. The owner is not any of the following: <br />a. A real estate investment trust, as defined in the Internal <br />Revenue Code Section 856. <br />b. A corporation. <br />c. A limited liability company in which at least one (1) member is <br />a corporation. <br />d. Management of a mobilehome park, as defined in Civil Code <br />Section 798.2. <br />9. Housing restricted by deed, regulatory restriction contained in an agreement <br />with a government agency, or other recorded document as affordable <br />housing for persons and families of very low, low, or moderate income, as <br />defined in Health and Safety Code Section 50093, or subject to an <br />agreement that provides housing subsidies for affordable housing for <br />persons and families of very low, low, or moderate income, as defined in <br />Health and Safety Code Section 50093 or comparable Federal statutes. <br />K. “Residential Household” Any person or group of persons entitled to occupy a <br />rental unit under a lease with the landlord. <br />L. “Right to Return Rent” The tenant’s rent at the time the tenancy was terminated <br />plus any increase(s) allowed by the Tenant Protection Act of 2019 (Civil Code Section <br />1947.12), had the tenant continuously occupied the rental unit. <br />M. “Special-circumstances Household” An Eligible Residential Household (as <br />defined above and in Section 42.3(B)) that has any of the following characteristics: <br /> <br />8.A. - Page 26 of 85 <br />284
