Page | 6 <br />5/5/2026 <br />ATTY/DOCS-ORDINANCE-REGULATIONS/05-05-26 TENANT PROTECTION ORDINANCE ADMINISTRATIVE REGULATIONS <br />REV: 05-05-26 LF <br />1. At least 1 member is 62 years of age or older. <br />2. At least 1 member qualifies as disabled as defined by Title 42, United States <br />Code, Section 423 or Government Code Section 12955.3. <br />3. A household with 1 or more minor children (under 18 years of age) who are <br />legally dependent (as determined for Federal income tax purposes). <br />4. A household that has occupied their rental unit as their primary residence <br />for 5 or more consecutive years. <br />N. “Substantial Remodel” or “substantially remodel” Means either of the following <br />that cannot be reasonably accomplished in a safe manner that allows the tenant to <br />remain living in the rental unit and that requires the tenant to vacate the rental unit <br />for at least 30 consecutive days: <br />1. The replacement or substantial modification of any structural, electrical, <br />plumbing, or mechanical system that requires a permit from a governmental <br />agency; or <br />2. The abatement of hazardous materials, including lead-based paint, mold, or <br />asbestos, in accordance with applicable Federal, State, and local laws. <br />*NOTE: Cosmetic improvements or other work that can be performed <br />safely without having the unit vacated for 30 days or more, do not qualify as a <br />substantial remodel. <br />O. “Tenancy” The lawful occupation of a rental unit, including, but not limited to, a <br />lease. <br />P. “Tenant” A tenant, subtenant, lessee, sublessee, or any other person entitled to <br />the use or occupancy of a rental unit, to the exclusion of others, under a lease with <br />the landlord. <br />2.2 Applicability <br />The TPO applies to all rental units in incorporated Redwood City, except for the <br />following: (See the “Rental Unit” definition above for additional information) <br />1. Nonprofit hospitals, religious facilities, extended care, elder care, or adult care <br />residential facilities <br /> <br />2. Shared housing with the landlord <br /> <br />3.
