705 Veterans Boulevard Affordable Housing Project <br /> <br /> <br />2 <br /> <br /> <br />Scoping consultation regarding potential project impacts to tribal cultural resources is <br />complete. Based on this Agreement, the applicant, Eden Housing Inc., may submit an <br />application for a development subject to the streamlined, ministerial approval process <br />allowed under SB 35. <br /> <br />AGREEMENT <br /> <br />Based on the outcome of tribal consultation undertaken for the proposed project at 705 <br />Veterans Boulevard, the undersigned California Native American tribe and the Redwood City <br />Planning Division have developed the following measures, which shall be implemented by <br />the applicant, Eden Housing Inc.: <br /> <br />Native American Cultural Sensitivity Training <br />The project applicant, in consultation with the City, shall retain the services of a local <br />representative from the undersigned California Native American tribe to provide cultural <br />sensitivity training to work crews who will be involved in ground disturbing activities at the <br />project site. The training shall be conducted by a designated representative of the <br />undersigned California Native American tribe using tribal-approved materials, and in <br />coordination with a Tribal Cultural Monitor and project archaeologist. The training may <br />include, but is not limited to, the following: informing all project contractors, subcontractors <br />and work crew members to be on the alert for evidence of the presence of potential tribal <br />cultural resource(s), of how to identify the evidence of such a resource(s), and of stop work, <br />resource protection, and notification requirements in the event of suspected discovery of a <br />tribal cultural resource by construction crew members. This training is mandatory and all <br />construction personnel must attend prior to beginning work on the project site. The <br />contractors shall maintain a log documenting attendance of all personnel. This attendance <br />log of this training shall be sent to the City within 10 business days of the training taking <br />place. No construction personnel shall be permitted to participate in ground-disturbing <br />activities until they have completed the training. <br /> <br />Human Remains <br />In the event that human remains are encountered on the project site, work within 50 feet of <br />the discovery shall be redirected and the County Coroner notified immediately consistent <br />with the requirements of California Code of Regulations (CCR) Section 15064.5(e). State <br />Health and Safety Code Section 7050.5 states that no further disturbance shall occur until <br />the County Coroner has made a determination of origin and disposition pursuant to Public <br />Resources Code (PRC) Section 5097.98. If the remains are determined to be Native <br />American, the County Coroner shall notify the Native American Heritage Commission <br />(NAHC), which shall determine and notify a Most Likely Descendant (MLD). With the <br />permission of the property owner, the MLD may inspect the site of the discovery. The MLD <br />shall complete the inspection within 48 hours of notification by the NAHC. <br /> <br />If human remains are determined to be Native American, the MLD, in coordination with
