Economic & Planning Systems, Inc.12 <br />TENANT RIGHT TO RETURN - WHAT WOULD CHANGE? <br />•Right to return applies after owner move-in, unit withdrawal, demolition, or <br />substantial renovation, and right does not expire <br />–SB 330 already has similar requirements for demolition <br />–City TPO already has right to return for substantial renovation <br />•Adds new timelines and rights for tenants evicted when unit is withdrawn from <br />market and later offered for rent: <br />–After 2-years: Landlord liable for punitive damages <br />–After 5-years: Rent capped at prior level + allowable increases <br />–After 10-years: Must offer unit to displaced tenant upon request <br />Strengthens City’s TPO by increasing circumstances when <br />displaced tenants can move back to original rental units if / when <br />it’s returned to market
