In this way, SB 79 <br />supersedes local development controls. <br />SB 79 Project Eligibility Requirements <br />To qualify for SB 79, a residential development must be located within 0.5 miles of a transit-oriented <br />development stop and meet the eligibility criteria described in Table 2. For more information about the <br />SB 79 eligibility criteria, see ABAG/MTC’s Summary of SB 79 in Attachment A. <br />Table 2: SB 79 Project Eligibility Requirements <br />Zoning Sites must be zoned for residential, mixed-use, or commercial development. <br />Location <br />Projects cannot be located on a site that: <br />Contains more than two units where the development requires the demolition of <br />housing that is subject to rent or price control that has been occupied by tenants <br />within the past seven years, or; <br />Previously contained more than two units that were subject to price or rent control <br />and that were demolished within seven years before the submission of an <br />application. <br />Use <br />Restrictions Hotels, motels, other transient lodgings are not eligible. <br />Minimum <br />Density <br />Projects must have a density of at least 30 dwelling units per acre or the minimum density <br />allowed by local zoning, whichever is greater. <br />Minimum <br />Unit Count Projects must have at least 5 residential units. <br />Unit Size The average floor area across all units in a project may not exceed 1,750 square feet per <br />unit (net habitable area). <br />Affordable <br />Housing <br />Projects with 11 or more units must provide at least 7% of units affordable to extremely <br />low-income (ELI), 10% to very low-income (VLI), or 13% to low-income (LI) households. If <br />local inclusionary housing requirements8 provide for a higher percentage of affordable <br />units or deeper affordability, local inclusionary housing requirements shall apply. <br />Affordability <br />Term <br />Affordable units must be deed restricted as affordable for 55 years for rental units and <br />45 years for ownership units. <br />Labor <br />Standards <br />Projects over 85 feet in height must comply with prevailing wage and skilled and trained <br />workforce requirements.9 <br />8 The City’s Affordable Housing Ordinance (AHO) requires residential development projects with 20 or more units <br />to construct on-site affordable housing; projects with 5-19 units may pay a housing impact fee; and projects with <br />four or fewer units are exempt. For rental projects, 10% of the proposed units shall be affordable to moderate- <br />income households, 5% shall be affordable to low-income households (LI), and 5% shall be set aside for very low- <br />income households (VLI).
